The following is an itemized list of hazardous waste violations that have not been <br /> addressed for PROFESSIONAL AUTO REPAIR as of June 08, 2020. <br /> Open violations from February 07, 2020 inspection <br /> Violation#115-Failed to retain copy of manifest or bill of lading for spent lead acid batteries for 3 years. <br /> OBSERVATION: Bills of lading for the recycling of lead acid batteries from 2017 through present were not found <br /> on site.According to Cesar Davila, owner, he recycles about 10 batteries each month by returning the batteries to <br /> AC Delco. <br /> REGULATION GUIDANCE: <br /> (A)The generator shall use either the manifest or a bill of lading which fulfills the requirements of Title 13 CCR <br /> section 1161,to record the shipment of spent lead-acid storage batteries to a person who stores the batteries or <br /> who uses, reuses, recycles or reclaims the batteries or their components. <br /> (B)The generator shall retain, at the generator's place of business for at least three years, a legible copy of each <br /> manifest or bill of lading which identifies spent lead-acid storage batteries shipped to a person who stores the <br /> batteries or who uses, reuses, recycles or reclaims the batteries or their components. <br /> CORRECTIVE ACTION: Provide copies of battery core bill of lading records and a corrective action statement to <br /> the San Joaquin County Environmental Health Department within 30 days. <br /> ❑ This violation was corrected ❑This violation will be corrected by(date): <br /> ❑ Supporting documents included <br /> Describe actions taken or will be taken to correct violation: <br /> Violation#117-Failed to submit a written response within 30 days of receiving an inspection report. <br /> OBSERVATION: This business did not provide a written response to the inspection report dated 1/26/2016 within <br /> 30 days. The report was delivered to the business on 1/26/2016.The violations that were not corrected were: <br /> -Managed a hazardous waste with an inactive identification number. <br /> -Failed to submit a written response within 30 days of receiving an inspection report. <br /> -Failed to report program data electronically on the California Environmental Reporting System (CERS). <br /> -Failed to maintain all communication or alarm systems, spill control, or decontamination equipment by not having <br /> an eye wash station. <br /> -Failed to keep hazardous waste containers closed except when adding or removing hazardous waste. <br /> -Failed to completely label containers or tanks of hazardous waste. <br /> -Failed to properly manage used oil and fuel filters. <br /> REGULATION GUIDANCE: The operator of the site or facility which receives an inspection report shall submit a <br /> written response to the department or the local officer or agency authorized to enforce this chapter pursuant to <br /> subdivision (a)of Section 25180 within 60 days of receipt of the inspection report, or within a shorter time as the <br /> department or the local officer or agency may reasonably require,which shall include a statement documenting <br /> corrective actions taken by the operator or proposing corrective actions which will be taken by the operator,for <br /> purposes of compliance with this chapter, or disputing the existence of the violation. The local agency,the San <br /> Joaquin County Environmental Health Department, requires response within 30 days. <br /> CORRECTIVE ACTION: Provide a corrective action statement and supporting documentation to the San Joaquin <br /> County Environmental Health Department. <br /> Page 4 of 10 <br />
