The following is an itemized list of hazardous waste violations that have not been addressed for PROFESSIONAL AUTO REPAIR as of June 08, 2020. Open violations from February 07, 2020 inspection Violation#115-Failed to retain copy of manifest or bill of lading for spent lead acid batteries for 3 years. OBSERVATION: Bills of lading for the recycling of lead acid batteries from 2017 through present were not found on site.According to Cesar Davila, owner, he recycles about 10 batteries each month by returning the batteries to AC Delco. REGULATION GUIDANCE: (A)The generator shall use either the manifest or a bill of lading which fulfills the requirements of Title 13 CCR section 1161,to record the shipment of spent lead-acid storage batteries to a person who stores the batteries or who uses, reuses, recycles or reclaims the batteries or their components. (B)The generator shall retain, at the generator's place of business for at least three years, a legible copy of each manifest or bill of lading which identifies spent lead-acid storage batteries shipped to a person who stores the batteries or who uses, reuses, recycles or reclaims the batteries or their components. CORRECTIVE ACTION: Provide copies of battery core bill of lading records and a corrective action statement to the San Joaquin County Environmental Health Department within 30 days. ❑ This violation was corrected ❑This violation will be corrected by(date): ❑ Supporting documents included Describe actions taken or will be taken to correct violation: Violation#117-Failed to submit a written response within 30 days of receiving an inspection report. OBSERVATION: This business did not provide a written response to the inspection report dated 1/26/2016 within 30 days. The report was delivered to the business on 1/26/2016.The violations that were not corrected were: -Managed a hazardous waste with an inactive identification number. -Failed to submit a written response within 30 days of receiving an inspection report. -Failed to report program data electronically on the California Environmental Reporting System (CERS). -Failed to maintain all communication or alarm systems, spill control, or decontamination equipment by not having an eye wash station. -Failed to keep hazardous waste containers closed except when adding or removing hazardous waste. -Failed to completely label containers or tanks of hazardous waste. -Failed to properly manage used oil and fuel filters. REGULATION GUIDANCE: The operator of the site or facility which receives an inspection report shall submit a written response to the department or the local officer or agency authorized to enforce this chapter pursuant to subdivision (a)of Section 25180 within 60 days of receipt of the inspection report, or within a shorter time as the department or the local officer or agency may reasonably require,which shall include a statement documenting corrective actions taken by the operator or proposing corrective actions which will be taken by the operator,for purposes of compliance with this chapter, or disputing the existence of the violation. The local agency,the San Joaquin County Environmental Health Department, requires response within 30 days. CORRECTIVE ACTION: Provide a corrective action statement and supporting documentation to the San Joaquin County Environmental Health Department. Page 4 of 10
