Due to the absence of any existing public water systems in the area, and the fact that the area is nearly "built out, " this proposal appears to be acceptable. There is no history of water quality or quantity problems in the area. Sewage Disposal : The proposed lots are designed to be served by individual sep- tic systems, each with a leach field area of 12 ,000 square feet . Three of the 11 lots currently have residential dwellings with existing septic systems. The Local Health District indicates that percolation tests will be required on all 11 lots and that soil profile tests will be required on Lots 2 and 7 . Storm Drainage: The applicant proposes to construct a community storm drainage pond to serve all 11 lots. The Department cf Public Works has Identified two problems with the proposed pond: ( 1 ) The pond appears to be undersized; and ( 2 ) the pond is inaccessible for public maintenance. As proposed, the storm drainage pond is not acceptable to the Department of Public Works . Schools: The project site is within the New Jerusalem Elementary School District and the Tracy Joint Union High School District . The Tracy School District indicates that fees collected under the developer fee program (AB 2926) will not provide necessary funds for new school facilities. In order to provide addi- tional funding, the District suggests that the County and the District establish a Community Facilities District (under the Mello-Roos Bill) . Such a district would permit a tax revenue base for funding new facilities. Such a district may be appropriate for large areas where new development occurs. In the case of the Hempstead Court development , the small scale of the project makes the establishment of a Community Facilities District impractical . ENVIRONMENTAL CONSIDERATIONS : An Environmental Assessment was prepared for the proposed project on June 5 , 1987, which did not identify any significant environ- mental effects. Based on this assessment , a proposed Negative Declaration has been prepared for the Commission' s consideration.
