M CONDITIONS OF APPROVAL Unless otherwise specified, the approved use shall not be established nor building permits issued until the applicant has fulfilled all Conditions of Approval . 1 . Planning Division: a . The sandbar-skimming portion of the project shall be completed within five years of the commencement of opera- tions . The on-going yearly maintenance skimming to main- tain the site reclamation shall be permitted for 15 years thereafter . If the excavation does not commence within 18 months after the date of approval , the permit is ter- minated . The applicant shall notify the Planning Division in writing when the sandbar-skimming operations begin . b . A performance guarantee is required to ensure site rehabi- litation and compliance with Conditions of Approval . The amount of the guarantee is and will be fully in force for any phase which is being excavated . The estimated cost of rehabilitating each phase must be reviewed by the Department of Public Works and the McMullin Reclamation District No . 2075 . The type of financial guarantee pro- posed by the applicant under this Section must be found acceptable by County Counsel prior to the public hearing on the permit . The type of financial guarantee may be , but is not limited to, the following : ( 1 ) A faithful' performance bond . ( 2 ) A property escrow or escrow account . ( 3 ) A trust fund. c. Prior to commencement of operations , a revegetation plan shall be approved by the Department of Fish and Game . A copy of this approved plan shall be submitted to the Planning Division . 2 . State Department of Fish and Game a . The nine acres to be revegetated will be identified within the area shown on the Land Use map. b. A revegetation plan shall be developed and submitted to the Department of Fish and Game for approval within 90 days . The plan shall include the planting schedule , spe- cies , densities , and maintenance. c .
