Harry Islas -2- <br /> The proposed project will have a significant adverse impact upon <br /> the high fish and/or wildlife values found in this portion of Old <br /> River and may adversely affect other nearby waterways . The <br /> Department, therefore , recommends a Draft Environmental Impact <br /> Report ( EIR) be prepared pursuant to Section 15065 of CEQA <br /> Guidelines . The EIR should discuss and mitigate the following: <br /> 1 . The project ' s impact upon the Swainson' s hawk . <br /> A survey should be done by a qualified biologist <br /> to determine if a Swainson ' s hawk nest occurs <br /> within or near the project site . If a nest tree <br /> is found, mitigation will need to be developed <br /> to protect the sensitive hawk. <br /> 2. The project' s long-term growth inducing impact <br /> upon other environmentally sensitive areas along <br /> Old River. <br /> 3 . The waterways along Old River are relatively <br /> shallow. The proposed marina will likely create <br /> the need to dredge Old River and other nearby <br /> waterways in order to allow the boaters who use <br /> the marina to gain access to the Delta. The EIR <br /> should discuss in detail this issue , including <br /> how dredging would be done , identify any <br /> proposed spoil sites , discuss any anticipated <br /> impacts upon the adjacent riparian vegetation <br /> along Old River , etc . Again, mitigation should <br /> be proposed for any adverse impacts . <br /> 4 . The method of sewage treatment proposed and the <br /> possible impacts upon the existing water quality <br /> in Old River should be thoroughly discussed and <br /> mitigated. <br /> The Department looks forward to reviewing the EIR when it is <br /> prepared .
