Mr . Harry Islas -2-
The proposed project will have a significant adverse impact upon
the high fish and/or wildlife values found in this portion of Old
River and may adversely affect other nearby waterways . The
Department, therefore , recommends a Draft Environmental Impact
Report ( EIR) be prepared pursuant to Section 15065 of CEQA
Guidelines . The EIR should discuss and mitigate the following:
1 . The project ' s impact upon the Swainson' s hawk .
A survey should be done by a qualified biologist
to determine if a Swainson ' s hawk nest occurs
within or near the project site . If a nest tree
is found, mitigation will need to be developed
to protect the sensitive hawk.
2. The project' s long-term growth inducing impact
upon other environmentally sensitive areas along
Old River.
3 . The waterways along Old River are relatively
shallow. The proposed marina will likely create
the need to dredge Old River and other nearby
waterways in order to allow the boaters who use
the marina to gain access to the Delta. The EIR
should discuss in detail this issue , including
how dredging would be done , identify any
proposed spoil sites , discuss any anticipated
impacts upon the adjacent riparian vegetation
along Old River , etc . Again, mitigation should
be proposed for any adverse impacts .
4 . The method of sewage treatment proposed and the
possible impacts upon the existing water quality
in Old River should be thoroughly discussed and
mitigated.
The Department looks forward to reviewing the EIR when it is
prepared . If we can be of further assistance , please contact ,
Patricia Perkins , Wildlife Management Supervisor, telephone
( 916 ) 355-7010 .
Sincerely,
.
James D. Messersmith
Regional Manager
