Item No. 1 <br /> PC: 8-6-87 <br /> VR-86-5/UP-86-6 <br /> Page 1 <br /> RECOMMENDATION <br /> The Planning Division recommends that the Planning Commission <br /> deny, without prejudice, Variance Application No. VR-86-5 and Use <br /> Permit Application No. UP-86-6, based upon the staff report findings. <br /> If , however, the Planning Commission concludes that it may be <br /> able to make affirmative findings for the applications, then the <br /> item should be continued so that the applicant may submit a <br /> revised site plan. The Planning Division would then prepare <br /> an environmental assessment based on the revised site plan. <br /> VARIANCE FINDINGS <br /> 1 . "Because of the special circumstances applicable to the pro- <br /> perty, including size, shape, topography, location, or <br /> surroundings, the strict application of the zoning regulation <br /> deprives the property of privileges enjoyed by other property <br /> in the vicinity and under identical zoning classification. " <br /> ° Staff could not make this finding. Most buildings in the RR <br /> zone are restricted to a 35-foot height limit . The <br /> Planning Title increases the permissible height for quasi- <br /> public buildings - such as the sanctuary - to 75 feet . The <br /> requested 108-foot sanctuary height far exceeds that for <br /> which any previous Variance has been granted. The church <br /> use could be established on a smaller scale with a sanc- <br /> tuary that conforms to the 75-foot height limitation. <br /> 2 . "The granting of the Variance will not constitute a grant of <br /> special privileges inconsistent with the limitations upon <br /> other properties in the vicinity and zone in which the pro- <br /> perty is situated. " <br /> Staff could not make this finding. Other quasi-public uses <br /> in Morada conform to the height regulations of the Planning <br /> Title. No building height Variances have been approved in <br /> Morada. <br /> 3. "The Variance will not authorize a use or activity which is <br /> not otherwise expressly authorized by the zone regulation <br /> governing the parcel of property. " <br /> Staff could make this finding. Planning Title Section <br /> 9-5002 (e) permits the following uses, subject to Use Permit <br /> approval : "Churches, including customary accessory uses <br /> such as social and recreation facilities, construction of <br /> an exclusively religious nature, administration and <br /> minister ' s residence. " <br />
