a. Prior to the issuance of a building permit for docks, the <br /> applicant shall show evidence of a valid -lease from the <br /> State Lands Commission. <br /> 9. AIR POLLUTION CONTROL DISTRICT: <br /> Conditions of Approval: <br /> a. During the construction/grading process, the applicant <br /> shall implement the District' s dust control practices. <br /> b. The applicant shall apply for an Authority to Construct <br /> and Permit to Operate for gasoline storage or dispensing <br /> facilities. <br /> C. An Authority to Construct and Permit to Operate shall not <br /> be required for piston type internal combustion engines <br /> with a rating of 65 brake horsepower or less. <br /> d. The applicant shall notify the District in writing one <br /> week prior to actual construction/grading. <br /> e. The applicant shall maintain adequate records of air <br /> quality mitigation measures for the District' s <br /> inspections. <br /> 10. RECLAMATION DISTRICT NO. 548 : <br /> a. The applicant shall submit engineering studies, <br /> conforming to the Corps of Engineers ' Standards for Urban <br /> Areas, that define levee improvements necessary to <br /> improve the levee system between levee Station 578-72 and <br /> the southeast boundary of the property. <br /> b. The applicant shall pay to the District an amount equal <br /> to the cost of such improvements as determined by the <br /> District in accordance with law, upon the earlier of <br /> Phase II or concurrently with the construction of the <br /> linear dock. Said payment shall be credited to all <br /> available Way Bill reimbursements, if any. <br /> C. The applicant shall not construct any facility within 100 <br /> feet of the existing land-side toe of the levee without <br /> the District's approval. <br /> d. The applicant shall not plant, in any manner or form, <br /> vegetation of any type on the levee crest or slopes <br /> without District approval. <br /> e. The applicant shall not park vehicles, other than those <br /> authorized by the District, on the levee beyond the <br /> siphon at levee Station 578-72 . <br /> R-91-741 -10- RV-88-26 <br />
