1 - <br /> 16 January 2004 <br /> AGE-NC Project No. 02-0964 <br /> Page 2 of 4 <br /> In letters dated 21 July and 26 September 2003, the USTCF requested the Sutter Office <br /> Center supply substantial evidence that four underground storage tanks (USTs)were abandoned in <br /> place in 1960, evidence that UST were still located on the property and the same, that documents, <br /> that the abandoned UST or system were the source of the release which is being mitigated. <br /> Based on the SWRCB Staff Decision memo, dated 08 December 2003, and my telephone <br /> conferences with Ms. Barbara Rempel, it is my understanding that the Claims Review Unit - <br /> Technical Review Unit is taking the position that the fact that Sutter Office Center are the owners <br /> of the real property where the abandoned USTs were located,is not sufficient evidence to establish <br /> that the Sutter Office Center are the owners of the abandoned USTs. <br /> AGE and.Sutter Office Center has made a submittal that the Sutter Office Center ownership <br /> of the property is sufficient to demonstrate that Sutter Office Center owns the abandoned USTs,and <br /> makes them eligible for their placement on the priority list and a eligible for a USTCF claim.As stated <br /> in AGE's letters dated 27 May 2003 and 27 October 2003, four USTs were abandoned in place, as <br /> verified by the then accurate City of Stockton Fire Department permit for UST abandonment,on 19 <br /> February 1960. This permit does represent records from the City of Stockton Fire Department. The <br /> installation of the UST prior to abandonment in place is a necessity, as stated by this permit. One <br /> must assume the UST were installed for this action, inspection of said USTs abandonment by fire <br /> department personnel, to legally occur and be documented.. <br /> AGE and Sutter Office Center further submitted a site photograph of the 1950's,documenting <br /> the presence of the dispenser on the site.No other reported USTs were operational on the site during <br /> this time. Due to the evidence of the presence of a fuel dispensing island and documentation of the <br /> presence of four, 550-gallon UST on the site, at a minimum prior to 1960, AGE and Sutter Office <br /> Center,respectfully,submit that fuel was dispensed from the site,noting that the only other practical <br /> explanation for the documented presence ofboth items,including their connections,must include that <br /> ambient air was being dispensed from the fuel pumping island throughout its operation. <br /> AGE and Sutter Office Center further submitted within AGE's letters dated 27 May 2003 and <br /> 27 October 2003 and fax memo,dated 23 July 2003,that historical Polk street directory of Stockton <br /> and a Sanborn Map(fire insurance map)indicated that a gas filling station operated at the northeast <br /> comer of the site from 1935 until 1941,which were named Harry Harvey Gas and Bowman&Box <br /> Gas Station, and a cab service operated at the same location from 1942 until 1958, named <br /> ServiceNeterans Cab Company. <br /> AGE and Sutter Office Center have submitted documentation that the UST are currently <br /> abandoned in place,by signature of the USTCF claim application.Site reconnaissance indicates their <br /> presence at the site. Additionally, AGE and Sutter Office Center further submitted letters from the <br /> San Joaquin County Environmental Health Department(EHD)documenting two separate operational <br /> locations for USTs. <br /> Advanced GeoEnvironmental,Inc. <br />
