As you know, Carl Bennett died in December of 1995. I forwarded to you a copy of the Will, Trust Agreement, and Death Certificate so that this claim can now be put in his daughter's name, Lois Irene Freer. Additionally, I wanted to update you as far as what is happening at the property. The prior property owners, Marie Carroll and Joseph Pugliese, are still residing at the property despite the foreclosure sale in January, 1996. An Unlawful Detainer action has been filed with the Court, and trial was held on Wednesday, May 8, 1996. Our client prevailed at trial and was awarded judgment for possession of the premises, The Sheriff will be serving the documents on Marie Carroll and Joseph Pugliese to leave the premises within five (5) days or they will forcibly be removed by the San Joaquin County Sheriff's Office. This Writ of Possession should be served within the next week. After Ms. Carroll and Mr. Pugliese have successfully been evicted, we will then proceed to have our consultants commence the site investigation. Hopefully, we will encounter no further roadblocks from Mr. Pugliese or Ms. Carroll. A Request for Reimbursement will be forwarded to you as soon as we have been able to do the site investigation, file the reports with the County, and obtain appropriate billing from the consultants.
