In <br /> addition, the EHD has a contract with the California State Water Resources <br /> Control Board (SWRCB) for reimbursement of the costs of overseeing the <br /> corrective actions at leaking UST sites, which also provides authority and <br /> contains other requirements. The definition of a responsible party (copy <br /> enclosed) is contained in the laws and the SWRCB contract. The requirements <br /> for investigation and remediation are contained in the laws. One requirement in <br /> the SWRCB contract is that the EHD request concurrence from the Central <br /> Valley Regional Water Quality Control Board (CVRWQCB) on "No Further.Action <br /> Required" (NFAR) determinations. Therefore, EHD will discuss the corrective <br /> action at this site with the CVRWQCB so they can express concerns prior to the <br /> site being considered for a NFAR determination. <br /> The first unauthorized release from UST's at this site occurred prior to August <br /> 1986. The release was discovered in August 1986, when four UST's were <br /> removed and contaminated soil and groundwater were observed. The listed <br /> responsible parties for that case are Mobil Oil Company, BP Oil Company and <br /> SMS Management Company. <br /> In preparation for the conference call, the EHD staff reviewed the EHD file <br /> information for the site and found that in 1996 the concentrations of MTBE in the <br /> groundwater samples collected from monitoring wells MW2 and AMW5 increased <br /> significantly, indicating there had been an unauthorized release from the UST <br /> system operating at that time.
