:Fool
2375 Tracy Blvd., Tracy
Page 3
representative of site conditions" ... "no further action related to the petroleum
release(s) at the site is required". This language is used because sites are not
generally "clean" when they are "closed". Sites are closed because the site
information indicates that human health, safety and the environment are
adequately protected. If new information becomes available, including
information on new contaminants of concern, a site may be "reopened" (required
to perform additional investigation and/or remediation). j
i
If new information was provided, on the contamination from the former UST's that
were located on this site and the information showed that further corrective action
was required, the responsible parties would be identified according to the
definition in the law, based on the information available.
If the owner/operator of the UST system changed at this site and the site data
showed that another unauthorized release had occurred, the UST
owner/operator and SMS Management Company would be identified as
responsible parties for the new contamination resulting from the new
unauthorized release.
If you have any questions contact me at (209) 468-3449 or Harlin Knoll, Senior
REHS, at (209) 468-3442.
Donna Heran, REHS, Director
Environmental Health Department
f Margaret Lagorio, Supervising REHS
' Unit IV
I
Enc.
C: Dick Mathews -- ConocoPhillips
Kyle Christie —Atlantic Richfield
Jim Barton - CVRWQCB
i
