By copy of this <br /> letter to Mr. Knoll and Ms. Lagorio, we similarly extend our appreciation of their <br /> time yesterday to discuss matters relating to the location above-referenced. The <br /> purpose of this conference call was principally to clarify environmental issues <br /> relating to the above-referenced location about which you sent your letter of <br /> February 1, 2005 advising of Conoco/Phillips Company (COP) intent to close this <br /> location on or before the Lease expiration date of December 31, 2005. <br /> First to address the main discussion points of the call made yesterday, , <br /> namely: <br /> 1. You, Ms. Sewell, Mr. Knoll and Ms. Lagorio confirm that site <br /> contamination exists, resulting from a first release in 1988, a second <br /> release in 1996 and a possible third release in 1999. These various <br /> releases occurred during different ownership interests; commencing <br /> with Mobil in 1988, Tosco in 1996 and 1999. <br /> 2. You indicate that COP purchased the assetsAiabiIities of Tosca. Mr. <br /> Knoll of SCEHD indicates that Mobil, Tosco, and Save Mart are named <br /> as Responsible Parties (RP's), with the naming of COP to be included <br /> as an RP and which Ms. Sewell advises is required by law. Mr. Knoll <br /> agrees to send copies of the notices to Save Mart wherein it is named <br /> purportedly on the occasion of two separate dates relating to releases <br /> of contaminants by the operator at this location. <br />
