The following is an itemized list of hazardous waste violations that have not been <br /> addressed for 209 Express Auto Body as of July 24, 2020. <br /> Open violations from May 28, 2020 inspection <br /> Violation#101 - Managed a hazardous waste without an identification number. <br /> OBSERVATION This business does not have a hazardous waste ID number in the California Department of Toxic <br /> Substances Control (DTSC) database. <br /> REGULATION GUIDANCE: A hazardous waste generator shall not treat, store, dispose of, transport or offer for <br /> transportation, hazardous waste without having received an Environmental Protection Agency(EPA) Identification <br /> (ID) Number. A State EPA ID number is required for generators of less than 100 kg RCRA hazardous waste per <br /> month, less than one kg of acutely hazardous waste per month or any amount of non-RCRA hazardous waste. ID <br /> numbers are unique to a business and site location. <br /> CORRECTIVE ACTION: Go to the DTSC web site at https://dtsc.ca.gov/apply-for-hazardous-waste-epa-id-number/ <br /> to obtain an ID number . Immediately apply for your ID number and submit evidence to the San Joaquin County <br /> Environmental Health Department within 30 days. <br /> ❑ This violation was corrected ❑ This violation will be corrected by (date): <br /> ❑ Supporting documents included <br /> Describe actions taken or will be taken to correct violation: <br /> Violation#102 - Failed to determine if a waste is a hazardous waste. <br /> OBSERVATIONS: Dust generated from sanding vehicles prior to painting is cleaned up by an outside company and <br /> disposed of in the trash per Jesus Fraile (Manager). <br /> REGULATION GUIDANCE: Any person who generates a waste shall determine if the waste is a hazardous waste <br /> as specified in Title 22 California Code of Regulations (CCR). There are wastes that are listed as hazardous <br /> wastes. There are wastes that exhibit one or more of the hazardous waste characteristics: toxic, corrosive, reactive <br /> or ignitable. <br /> CORRECTIVE ACTION: Immediately stop disposing of sanding dust in the trash and make a hazardous waste <br /> determination for each waste , and manage it according to Title 22 CCR. Use Safety Data Sheets (SDS), waste <br /> sampling and test results or other knowledge to support your hazardous waste determination. Waste testing must <br /> be done using methods specified in Title 22 CCR including sections 66261.20-24. <br /> Submit a statement and supporting documentation with your hazardous waste determination. Demonstrate current <br /> storage and labeling for wastes determined to be hazardous wastes.
