Box 549
Woodbridge, CA 95258
NOTICE OF VIOLATION, DELINQUENT MONITORING REPORTS, LODI VINTNERS, INC.,
SAN JOAQUIN COUNTY
Lodi Vintners, Inc. is subject to Waste Discharge Requirements (WDRs) Order 93-112 issued
by the Central Valley Regional Water Quality Control Board (Central Valley Water Board).
The WDRs describe the conditions under which discharges from the facility may occur.
Provision E.1 of the WDRs also requires compliance with Monitoring and Reporting Program
(MRP) No. 93-112 and any revisions thereto, as ordered by the Executive Officer. The MRP
was revised by the Executive Officer and issued in April 2006; the Revised MRP (enclosed)
took effect 26 April 2006.
Revised MRP No. 93-112 requires submittal of monthly monitoring reports by the first day of
the second month following sampling (i.e., the January report is due by 1 March), submittal of
quarterly monitoring reports including groundwater monitoring by the first day of the second
month after the quarter (i.e., the first quarter report for January through March is due by
1 May), and submittal of annual reports by 1 February of each year.
A review of the file for this facility revealed that the last monthly monitoring report received by
this office was for February 2006. Additionally, the last quarterly monitoring report received by
this office was for the second quarter of 2007.
On 2 November 2009, Central Valley Water Board staff contacted Lodi Vintners by phone and
requested the delinquent monitoring reports be submitted. As of 1 January 2010 Central
Valley Water Board staff has not received the delinquent monitoring reports.
Pursuant to the State Water Resources Control Board's Enforcement Policy, failure to submit
reports required by WDRs or California Water Code section 13267 within 30 days from the
due date is a priority violation. For the period reviewed, Lodi Vintners, Inc. has failed to submit
62 reports. Because each day a report is late is considered a violation, Lodi Vintners has
accumulated 45,335 violations.
California Environmental Protection Agency
CIVRecycled Paper
