Box 549 <br /> Woodbridge, CA 95258 <br /> NOTICE OF VIOLATION, DELINQUENT MONITORING REPORTS, LODI VINTNERS, INC., <br /> SAN JOAQUIN COUNTY <br /> Lodi Vintners, Inc. is subject to Waste Discharge Requirements (WDRs) Order 93-112 issued <br /> by the Central Valley Regional Water Quality Control Board (Central Valley Water Board). <br /> The WDRs describe the conditions under which discharges from the facility may occur. <br /> Provision E.1 of the WDRs also requires compliance with Monitoring and Reporting Program <br /> (MRP) No. 93-112 and any revisions thereto, as ordered by the Executive Officer. The MRP <br /> was revised by the Executive Officer and issued in April 2006; the Revised MRP (enclosed) <br /> took effect 26 April 2006. <br /> Revised MRP No. 93-112 requires submittal of monthly monitoring reports by the first day of <br /> the second month following sampling (i.e., the January report is due by 1 March), submittal of <br /> quarterly monitoring reports including groundwater monitoring by the first day of the second <br /> month after the quarter (i.e., the first quarter report for January through March is due by <br /> 1 May), and submittal of annual reports by 1 February of each year. <br /> A review of the file for this facility revealed that the last monthly monitoring report received by <br /> this office was for February 2006. Additionally, the last quarterly monitoring report received by <br /> this office was for the second quarter of 2007. <br /> On 2 November 2009, Central Valley Water Board staff contacted Lodi Vintners by phone and <br /> requested the delinquent monitoring reports be submitted. As of 1 January 2010 Central <br /> Valley Water Board staff has not received the delinquent monitoring reports. <br /> Pursuant to the State Water Resources Control Board's Enforcement Policy, failure to submit <br /> reports required by WDRs or California Water Code section 13267 within 30 days from the <br /> due date is a priority violation. For the period reviewed, Lodi Vintners, Inc. has failed to submit <br /> 62 reports.
