The following is an itemized list of hazardous waste violations that have not been <br /> addressed for Dollar General #13357 as of May 29, 2020. <br /> Open violations from August 12, 2019 inspection <br /> Violation#103-Failed to retain hazardous waste determination including waste analysis on site for 3 <br /> years. <br /> When asked how employees determine which of the differently categorized hazardous waste(HW)totes a waste <br /> item belongs in, Tony Yang, Store Manager, said each item is scanned using a hand-held scanner,which will <br /> sometimes state which HW tote the item belongs in. Tony indicated that when the scanner does not specify which <br /> HW tote an item belongs in, employees will read the item's label and ingredients, as well as the Dollar General <br /> (DG) HW guidance poster and documents,which provide product examples and key words for each of the HW <br /> categories,to determine which HW tote an item belongs in (see photos IMG 8262, 8264).When asked what <br /> employees do if they are still unsure about which HW tote a waste item belongs in,Tony stated he will call Eric <br /> Voyles, DG Director of Facilities Management.Tony also mentioned that he is able to submit a ticket notification <br /> using the facility's computer to notify DG Corporate if the hand-held scanner does not provide a HW classification <br /> for an item when that item is scanned. <br /> The waste items listed below were observed in the HW totes, but at the time of inspection it could not be <br /> determined how the HW determinations for each of these items were made.The hand-held scanner did not specify <br /> which HW tote the items should go in, and the DG Environmental Compliance HW poster and guidance <br /> documents did not list these types of items: <br /> 1. The following waste items were found in totes labeled as Flammable HW(IMG 8156, 8163-8, 8241, 8252-4): <br /> -A True Living Citro Candle <br /> -A DG Home Tropical Nector Fragranced Candle <br /> -A Glade Candle <br /> -A True Living Paradise Orchid Candle <br /> -Two wax candles of unknown brands <br /> 2.Adjacent to the HW storage shelves were five grey totes labeled as Toxic HW,two blue totes labeled as <br /> Universal Waste, and one blue tote labeled as Flammable HW, stacked on top of each other. One of these Toxic <br /> HW totes contained the following waste items:The following waste items were found in HW tote labeled as Toxic <br /> HW(IMG 8208-8211, 8222-3, 8240): <br /> -A bottle of Stainmaster carpet pet stain remover <br /> -A bottle of Sewing Patch Craft&Repair Liquid Adhesive <br /> The business operator does not have hazardous waste determination records that support the current handling <br /> and disposal of the waste. <br /> A business operator shall keep records of any hazardous waste determinations made in accordance with Title 22 <br /> California Code of Regulations(CCR)section 66262.11 for at least three years from the date that the waste was <br /> last sent to an on-site or off-site treatment, storage, or disposal facility. The records may include Safety Data <br /> Sheets(SDS),waste test results or other hazardous waste determination documentation. <br /> Assemble the hazardous waste determination documentation for the above listed waste observed at the time of <br /> inspection, maintain on site and submit a copy to the San Joaquin County Environmental Health Department <br /> (EHD). <br /> If hazardous waste determination documentation is not available, immediately make a hazardous waste <br /> determination and begin managing the above listed wastes as specified in Title 22 CCR. Use Safety Data Sheets <br /> (SDS),waste sampling and test results or other knowledge to support your hazardous waste determination. Waste <br /> testing must be done using methods specified in Title 22 CCR including sections 66261.20-24. Submit a <br /> statement and supporting documentation with your hazardous waste determination. <br /> Demonstrate current storage and labeling for wastes determined to be hazardous wastes. Provide disposal <br /> records for wastes determined to be hazardous wastes and stored longer than the number of days specified in Title <br /> Page 2 of 7 <br />
