Several metal oil filters were also piled on top of a 55 gallon drum in the secondary <br /> containment draining. <br /> REGULATION GUIDANCE:A hazardous waste generator must maintain and operate its facility to minimize the <br /> possibility of a fire, explosion, or any unplanned sudden or non-sudden release of hazardous waste or hazardous <br /> waste constituents to air, soil, or surface water which could threaten human health or the environment. <br /> CORRECTIVE ACTION: Immediately clean the secondary containment. Manage the waste according to Title 22 <br /> California Code of Regulations for hazardous waste. Submit a statement and supporting documentation to the San <br /> Joaquin County Environmental Health Department describing the storage and final disposition of the cleaned up <br /> waste. <br /> This is a Class II violation. <br /> 303 CCR 66262.34(d)(2) Failed to maintain all communication or alarm systems, spill control, or decontamination <br /> equipment. <br /> OBSERVATION:The used oil secondary containment held several gallons of used oil, metal oil filters, and oily <br /> debris. <br /> REGULATION GUIDANCE:All facility communications or alarm systems,fire protection equipment,spill control <br /> equipment, and decontamination equipment,where required, shall be tested and maintained as necessary to assure <br /> its proper operation in time of emergency. <br /> CORRECTIVE ACTION: Immediately clean the secondary containment. Provide a corrective action statement to <br /> the San Joaquin County Environmental Health Department within 30 days. <br /> This is a repeat violation, Class II. <br /> 403 CCR 66262.34(4)(2) Failed to keep hazardous waste containers closed except when adding or removing hazardous <br /> waste. <br /> OBSERVATION: In the shop, one white 5 gallon bucket containing oily rags and paper/metal oil filters was missing a <br /> lid. <br /> REGULATION GUIDANCE:A container holding hazardous waste shall always be closed during transfer and <br /> storage, except when it is necessary to add or remove waste. <br /> CORRECTIVE ACTION: Immediately close the container and ensure all hazardous waste containers are closed <br /> when not adding or removing waste.
