SAN J O A Q U I N Environmental Health Department <br /> C; OU N 1- Y -- <br /> Small Quantity Hazardous Waste Generator Inspection Report <br /> Facility Name: Facility Address : Date : <br /> CBUSO dba Turner Road Vintners (West) 5852 W Turner Rd , Lodi January 07 , 2020 <br /> SUMMARY OF VIOLATIONS <br /> (CLASS 1, CLASS II, or MINOR - Notice to Comply) <br /> Item # Remarks <br /> 101 CCR 66262 . 12 Managed a hazardous waste without an identification number. <br /> OBSERVATION : This business does not have a hazardous waste ID number in the California Department of Toxic <br /> Substances Control ( DTSC ) database . <br /> REGULATION GUIDANCE : A hazardous waste generator shall not treat, store , dispose of, transport or offer for <br /> transportation , hazardous waste without having received an Environmental Protection Agency ( EPA) Identification <br /> ( ID ) Number. A State EPA ID number is required for generators of less than 100 kg RCRA hazardous waste per <br /> month , less than one kg of acutely hazardous waste per month or any amount of non-RCRA hazardous waste . ID <br /> numbers are unique to a business and site location . <br /> CORRECTIVE ACTION : Go to the DTSC web site at https : //dtsc.ca . gov/apply-for-hazardous-waste-epa-id-number/ <br /> to obtain a State ID number. Immediately apply for your ID number and submit evidence to the San Joaquin County <br /> Environmental Health Department within 30 days . <br /> This is a minor violation . <br /> 102 CCR 66262 . 11 Failed to determine if a waste is a hazardous waste. <br /> OBSERVATIONS : The facility has a parts washer that is managed by Cintas . Cintas services the parts washer <br /> waste and will periodically generate a parts washer filter. Invoice 922782132 shows that the parts washer, listed <br /> " Safewasher, " was serviced and had a filter replaced on 7/11 /2019 . The waste was disposed of on a <br /> non-hazardous waste manifest. Gabino Pelayo , Maintenance Manager, stated that only filter waste is generated <br /> from the parts washer. <br /> REGULATION GUIDANCE : Any person who generates a waste shall determine if the waste is a hazardous waste <br /> as specified in Title 22 California Code of Regulations (CCR) . There are wastes that are listed as hazardous <br /> wastes . There are wastes that exhibit one or more of the hazardous waste characteristics : toxic , corrosive , reactive <br /> or ignitable . <br /> CORRECTIVE ACTION : Immediately cease disposal , make a hazardous waste determination for the parts washer <br /> waste , and manage it according to Title 22 CCR . Use Safety Data Sheets (SDS ), waste sampling and test results or <br /> other knowledge to support your hazardous waste determination . Waste testing must be done using methods <br /> specified in Title 22 CCR including sections 66261 . 20-24 . <br /> Submit a statement and supporting documentation with your hazardous waste determination . Demonstrate current <br /> storage and labeling for wastes determined to be hazardous wastes .
