S0 JOA U 1 Environmental Health Department <br /> U ; i y I AMENDED <br /> 1/22/2020 <br /> Small Quantity Hazardous Waste Generator Inspection Report <br /> Facility Name: Facility Address: Date: <br /> ULLOAS TOW&AUTO REPAIR 620 S WILSON WAY, STOCKTON January 16, 2020 <br /> SUMMARY OF VIOLATIONS <br /> (CLASS I,CLASS II,or MINOR-Notice to Comply) <br /> Item# Remarks <br /> 101 CCR 66262.12 Managed a hazardous waste without an identification number. <br /> OBSERVATION: This business does not have an active hazardous waste ID number in the California Department <br /> of Toxic Substances Control (DTSC)database. <br /> REGULATION GUIDANCE: A hazardous waste generator shall not treat, store, dispose of,transport or offer for <br /> transportation, hazardous waste without having received an Environmental Protection Agency(EPA) Identification <br /> (ID) Number.A State EPA ID number is required for generators of less than 100 kg RCRA hazardous waste per <br /> month, less than 1 kg of acutely hazardous waste per month or any amount of non-RCRA hazardous waste. ID <br /> numbers are unique to a business and site location. <br /> CORRECTIVE ACTION: Go to the DTSC web site at <br /> https://dtsc.ca.gov/apply-for-hazardous-waste-epa-id-number/to reactivate your State ID number. Immediately <br /> reactivate your ID number and submit evidence to the San Joaquin County Environmental Health Department <br /> within 30 days. <br /> This is a repeat violation, Class II. <br /> 102 CCR 66262.11 Failed to determine if a waste is a hazardous waste. <br /> OBSERVATIONS: Metal brake lathe shavings were found on a counter next to the facility's brake lathe(see photos <br /> 0546-7). It was unclear at the time of inspection how the facility manages these metal brake lathe shavings. <br /> REGULATION GUIDANCE: Any person who generates a waste shall determine if the waste is a hazardous waste <br /> as specified in Title 22 California Code of Regulations(CCR). There are wastes that are listed as hazardous <br /> wastes. There are wastes that exhibit one or more of the hazardous waste characteristics:toxic, corrosive, reactive <br /> or ignitable. Metal particles 100 microns or smaller in size must be handled and disposed of as hazardous waste <br /> if the metal is determined to be a hazardous waste. Metal particles larger than 100 microns in size can be recycled <br /> as scrap metal. <br /> CORRECTIVE ACTION: Immediately make a hazardous waste determination for the metal brake lathe shavings, <br /> and manage it according to Title 22 CCR. Particles 100 microns or smaller must be handled as hazardous waste if <br /> the metal is determined to be a hazardous waste. Use waste sampling and test results or other knowledge to <br /> support your hazardous waste determination.Waste testing must be done using methods specified in Title 22 <br /> CCR including sections 66261.20-24. <br /> Submit a statement and supporting documentation with your hazardous waste determination. Demonstrate current <br /> storage and labeling for wastes determined to be hazardous wastes.
