City of Tracy - PW • 209-1391-4472 10/12/01 07P P.001 <br /> p d. <br /> AGREEMENT BETWEEN THE CITY OF TRACY AND <br /> GEORGIA-PACIFIC CORPORATION FOR <br /> THE USE OF CITY PROPERTY LOCATED AT 75 WEST VALPICO ROAD FOR THE <br /> PURPOSES OF GROUNDWA'T'ER REMEDIATION <br /> TRIS AGREEMENT is made and entered into this 29th day of June, 2000, by and between the <br /> CITY OF TRACY, a municipal corporation, hereinafter designated as "CITY", and GEORGIA-PACIFIC <br /> CORPORATION, a Georgia Corporation hereinafter designated as "G-P." <br /> RF,CTTALS <br /> WHEREAS, Under directive of the California Regional Water Quality Control Board, Central <br /> Valley Region (RWQCB), G-P is required to initiate groundwater extraction and treatment operations <br /> around the City stormwater detention.Basin ("City Basin-) at the north end of the former G-P chemical <br /> packaging plant and <br /> WHEREAS,G-P has requested permission to use the City Basin; and <br /> WHEREAS, RWQCB has requested that the City facilitate the G-P groundwater remediation <br /> project by participating with G-P in the Waste Discharge Requirements (WDR) for the groundwater clean- <br /> up;and <br /> WHEREAS, This proposed remediation project is beneficial to the City as it will clean-up the <br /> groundwater immediately adjacent to City-owned facilities including the South Arta Well. <br /> NOW THEREFORE,THE PARTIES MUTUALLY AGREE AS FOLLOWS: <br /> 1. Descriotion of Project <br /> The former GP chemical packaging plant is located near the southern boundary of the City of <br /> Tracy(City), A site plan is included as Figure 1. North of the site is the City's storm water <br /> basin(Basin)and an irrigation canal (Canal)owned and operated by the West Side Irrigation <br /> Distriet(WSID). A residential neighborhood is located north and west of the Canal. A <br /> dissolved chloroform plume lies beneath the Basin and extends under the Canal and into the <br /> neighborhood. A Draft interim Remediation Plan,dated February 4, 2000, was submitted to . <br /> the California Regional Water Quality Control Board for their review and approval. <br /> The objective of the Interim Remediation Plan(IRP) is to remediate chloroform-affected <br /> groundwater in the shallow water-bearing(mit(30 to 65 feet below ground surface)in the <br /> vicinity of the Basin. The remedial goal for groundwater at this site has been stipulated by <br /> the California Regional Water Quality Control Board, Central Valley Region (RWQCB)to <br />
