P . ) regarding violations of the <br /> Cleanup and Abatement order (C&A) issued 25 September 1984. we <br /> are very concerned that G. P. continues to violate the C&A and <br /> that G.P. does not understand the gravity of this situation. The <br /> sludges are still in the pond, and the only analysis done to date <br /> is not sufficient to determine whether or not a hazard exists. <br /> Up to 140 ppb chloroform has been found in the ground water <br /> beneath the pond. The EPA one in a million cancer risk level <br /> for chloroform is 0 . 2 ppb. According to Section 13350 of the <br /> California water Code , any person who intentionally cr negli- <br /> gently violates a C&A may be liable civilly in a sum not to <br /> exceed $6000 for each day such violation occurs. <br /> G.P. must comply with items 1 , 2, and 5 of the C&A by 28 December <br /> 1984 . G. P. must also submit weekly reports on Friday of each <br /> week outlining the progress which has taken place on the investi- <br /> gation and cleanup project the previous week. The first report <br /> will be due on 14 December 1984 and will describe actions taken <br /> during the week of 2 December through 8 December 1984 . These <br /> reports shall be detailed, technical , and are required to be <br /> submitted weekly until Regional Board Staff determines otherwise. <br /> Failure to submit these reports, or continued non-compliance with <br /> the C&A will result in staff recommending further enforcement <br /> action. <br />
