In addition, a file review has found that <br /> the Discharger has not fully complied with its Monitoring and Reporting <br /> Program, as required by the TSO. <br /> The proposed revised TSO includes the increased flow limitations <br /> requested by the Discharger,but also requires the Discharger to control <br /> offensive odors, limit the use of wastewater for dust control to <br /> construction areas,perform a groundwater sample event, and evaluate the <br /> construction of a groundwater monitoring well. The TSO also describes <br /> the specific monetary penalties for failure to comply. <br /> It should be noted that approval of this increased flow rate is for the time <br /> period from June to September 2002 only. The Discharger has recently <br /> submitted a RWD for increased flow and salt loading rates; staff are <br /> evaluating this document and if all the required information has been <br /> submitted, then will prepare tentative updated WDRs for the Board's <br /> consideration at its September meeting. At this point, it is unknown what <br /> flow and salt limitations will be proposed in the tentative WDRs. <br /> RECOMMENDATION: Adopt the following items: (a) an Administrative Civil Liability Order in <br /> the amount of$150,000, and (b) a revision of California Water Code <br /> Section 13308 Time Schedule Order No. R5-2002-0014. <br /> Mgmt.
