CALIFORNIA AIONAL WATER QUALITY COTROL BOARD CENTRAL VALLEY REGION 3443 Routier Road, Suite A, Sacramento, California 95827 PUBLIC HEARING concerning ADMINISTRATIVE CIVIL LIABILITY ORDER AND REVISION TO CALIFORNIA WATER CODE SECTION 13308 TIME SCHEDULE ORDER for MUSCO OLIVE PRODUCTS AND THE STUDLEY COMPANY SAN JOAQUIN COUNTY Musco Olive Products and the Studley Company operate an olive processing and calming facility at 17950 Via Nicolo, Tracy. The Regional Board will consider adoption of an Administrative Civil Liability (ACL) Order and revision of California Water Code (CWC) Section 13308 Time Schedule (TSO) Order No. R5-2002-0014. The ACL Order addresses violations of Cleanup and Abatement Order No. 5-00-717 that occurred between 17 November 2000 and 25 January 2002. The proposed revision of the TSO, which was adopted on 15 January 2002, would allow increased wastewater flow rates until 6 September 2002. At that time, the flow rates will revert to those in the existing WDR Order or the Regional Board may consider adoption of new WDRs with an increased flow limit. A formal public hearing concerning this matter will be held during the Regional Board meeting which is scheduled for: DATE: 6-7 June 2002 TIME: 8:30 a.m. PLACE: Central Valley Regional Water Quality Control Board 3443 Routier Road, Suite A Sacramento, CA 95827 The designated parties for this hearing are as follows: • Staff of Central Valley Regional Board • Musco Olive Products and The Studley Company Only designated partigs will have these rights: to call and examine witnesses; to introduce exhibits; to cross-examine opposing witnesses; to impeach any witness; and to rebut the evidence against him or her. All other persons wishing to testify or provide comments are interested persons and not designated parties. Such interested persons may request status as a designated party for purposes of this hearing by submitting such request in writing to the Board no later than 30 May 2002. The request must explain the basis for status as a designated party and in particular how the person is directly affected by the discharge. Persons wishing to comment on this noticed hearing item must submit testimony, evidence, and/or comments in writing to the Regional Board no later than 30 May 2002. Written testimony, evidence, or comments submitted after 30 May 2002 will not be accepted and will not be incorporated into the administrative record if doing so would prejudice any party.
