CALIFORNIA AIONAL WATER QUALITY COTROL BOARD <br /> CENTRAL VALLEY REGION <br /> 3443 Routier Road, Suite A, Sacramento, California 95827 <br /> PUBLIC HEARING <br /> concerning <br /> ADMINISTRATIVE CIVIL LIABILITY ORDER AND REVISION <br /> TO CALIFORNIA WATER CODE SECTION 13308 TIME SCHEDULE ORDER <br /> for <br /> MUSCO OLIVE PRODUCTS AND THE STUDLEY COMPANY <br /> SAN JOAQUIN COUNTY <br /> Musco Olive Products and the Studley Company operate an olive processing and calming facility <br /> at 17950 Via Nicolo, Tracy. The Regional Board will consider adoption of an Administrative <br /> Civil Liability (ACL) Order and revision of California Water Code (CWC) Section 13308 Time <br /> Schedule (TSO) Order No. R5-2002-0014. The ACL Order addresses violations of Cleanup and <br /> Abatement Order No. 5-00-717 that occurred between 17 November 2000 and 25 January 2002. <br /> The proposed revision of the TSO, which was adopted on 15 January 2002, would allow <br /> increased wastewater flow rates until 6 September 2002. At that time, the flow rates will revert <br /> to those in the existing WDR Order or the Regional Board may consider adoption of new WDRs <br /> with an increased flow limit. <br /> A formal public hearing concerning this matter will be held during the Regional Board meeting <br /> which is scheduled for: <br /> DATE: 6-7 June 2002 <br /> TIME: 8:30 a.m. <br /> PLACE: Central Valley Regional Water Quality Control Board <br /> 3443 Routier Road, Suite A <br /> Sacramento, CA 95827 <br /> The designated parties for this hearing are as follows: <br /> • Staff of Central Valley Regional Board <br /> • Musco Olive Products and The Studley Company <br /> Only designated partigs will have these rights: to call and examine witnesses; to introduce <br /> exhibits; to cross-examine opposing witnesses; to impeach any witness; and to rebut the evidence <br /> against him or her. All other persons wishing to testify or provide comments are interested <br /> persons and not designated parties. Such interested persons may request status as a designated <br /> party for purposes of this hearing by submitting such request in writing to the Board no later than <br /> 30 May 2002. The request must explain the basis for status as a designated party and in <br /> particular how the person is directly affected by the discharge. <br /> Persons wishing to comment on this noticed hearing item must submit testimony, <br /> evidence, and/or comments in writing to the Regional Board no later than 30 May 2002. <br /> Written testimony, evidence, or comments submitted after 30 May 2002 will not be <br /> accepted and will not be incorporated into the administrative record if doing so would <br /> prejudice any party. <br />
