ADMINISTRATIVE CIVIL LIABILITY COMPLAINT R5-2002-0502 <br /> REVISED WAIVER <br /> By signing this waiver, Musco Olive Products and the Studley Company agree to waive their rights to a <br /> hearing before the Central Valley Regional Water Quality Control Board and to remit payment for civil <br /> liability imposed in the amount of one hundred fifty thousand dollars ($150,000.00)by checks made <br /> payable to the State Water Resources Control Board Cleanup and Abatement Account. Each check must <br /> contain a reference to ACL Complaint No. R5-2002-0502. <br /> At Musco Olive Products and the Studley Company's request, a payment schedule is included in this <br /> revised waiver. The$150,000 administrative liability will be paid in three$50,000 payments. The first <br /> payment is due on 29 May 2002, the second payment is due on 22 August 2002, and the third payment <br /> is due on 20 November 2002. <br /> Musco Olive Products and the Studley Company understand that they are giving up their rights to argue <br /> against the allegations made by the Executive Officer in this Complaint, and against imposition of, and <br /> the amount, of civil liability imposed. Musco Olive Products and the Studley Company understand that <br /> failure to pay the above amounts by the above dates will result in the full amount becoming immediately <br /> due, and may result in further enforcement action including,but not limited to, referral of the matter to <br /> the Attorney General for resolution. <br /> (Name) <br /> (Title) <br /> (Date) <br />
