Unfortunately, several discrepancies <br /> have been noted in the report and letters you submitted to support your request for <br /> closure. Enclosed is a memo describing information needed for you to submit to <br /> address the discrepancies. <br /> : You state in your 16 January 1991 letter that the site has been sold and the new owners <br /> are awaiting our concurrence before "revitalizing" the food processing plant. <br /> Agreements needed to reopen this (or any other) facility are not contingent upon our <br /> concurrence. The facility may reopen at the new owner's convenience and your <br /> continuing work can proceed because you have stated that you accept responsibility <br /> for the investigation and any necessary remediation. The investigation/remediation <br /> at the site and the daily operations of the facility are to be compatible and mutually <br /> non-interfering. As long as progress satisfactory to the Regional Board continues to <br /> be made to mitigate the contamination at the site, we would not consider including <br /> the new owners in formal enforcement actions. <br /> I share your concern for the length of time required to respond to your request and <br /> hope that this information allows you to proceed with your project.
