• DEFERRED FRONTAGE IMPROVEMENT AGREEMENT FOR UP-91-7 THIS AGREEMENT dated this July 1, 1991, by and between the STATE OF CALIFORNIA, DEPARTMENT OF TRANSPORTATION (Caltrans), District 10, Stockton, CA 95205, and the CROSSROADS GRACE COMMUNITY CHURCH, 1340 East Yosemite Avenue, Manteca, CA 95336. The application for Use Permit UP-91-7 was approved by San Joaquin County with certain conditions of approval that require GRACE COMMUNITY CHURCH to construct frontage improvements on State Route 120 along the frontage of Parcel APN 208-180-09, San Joaquin County. Right of Way Dedication is required from GRACE COMMUNITY CHURCH for property frontage along State Route 120. To achieve a width of 55 feet from centerline, GRACE COMMUNITY CHURCH is required to dedicate an additional estimated 25 feet of right of way. This dedication is to be completed prior to the issuance of building permits by San Joaquin County. A Standard Road approach is required on the north side of State Route 120 at Comconex Road. Both parties mutually agree to defer the construction of frontage improvements until such time as any zoning changes occur in San Joaquin County to the east of APN 208-180-09. When a zoning change occurs, whether or not any construction occurs on the adjacent properties to the east, GRACE COMMUNITY CHURCH will be required to widen State Route 120, per Caltrans standards, to 38 feet from centerline for the length of frontage of APN 208-180-09. An Encroachment Permit will be required for construction within the Caltrans Right of Way. IN WITNESS WHEREOF, the parties hereto have executed this Agreement on the date first above written.
