(b) A solid waste that exhil•i.ts the <br />characteristic of reactivity, }.nit is not <br />listed as hazardous waste in Si.i}apart D, <br />has the EPA Hazardous Waste number of <br />D003. <br />For the Cal Cedar fly ash, the reactivity was measure as cyanide <br />and sulfide concentrations. Neither cyanide and sulfide were <br />detected in either ash sample. Therefore, the fly ash would not <br />be classified as hazardous waste by this characteristic. <br />3.4 Characteristic of EP Toxicity <br />Per CFR 40, Part 20, Subpart C, Section 261.21, the characteris- <br />tic of EP Toxicity is defined as follows: <br />261.24 Characteristic of EP Toxicity. <br />(a) A solid waste exhibits the charac- <br />teristic of EP toxicity if, using the <br />test methods described in Appendix II or <br />equivalent methods approved by he <br />Administrator under the procedure set <br />forth in 260.20 and 260.21, the extract <br />from a representative sample of the <br />waste contains any of the contaminants <br />listed" in Table I at a concentration <br />equal to or greater than the respective <br />value given in that Table. Where the <br />.........._ <br />waste contains less than 0.5 percent <br />filterable solids, the waste itself, <br />after filtering, is considered to be the <br />extract for the purposes of this sec- <br />tion. <br />(b) A solid waste that exhibits the <br />characteristic of EP Toxicity, but is <br />not listed as a hazardous waste in <br />Subpart D, has the EPA Hazardous Waste <br />Number specified in table T which <br />corresponds to the toxic contaminant <br />causing it to be hazardous. <br />
