Included with your letter were analytical test results
of the ash for aquat'.c toxicity, per dstent and bioaccumulative
substances (inurganics) , and coc,:osivJ_.,y.
DHS has reviewed the submitted data and finds it to be inadequate
with respect to the number of samples taken to characterize your
waste (only one (1) sample was submitted for analysis) . DHS is
requesting you to increase your sample population to a minimum of
four _, ;,_) - samples in accordance with Section 66694, Title 22,
California Code of Regulations (CCR) to properly characterize your
waste. The samples should be taken over a period of time
sufficient to represent any variability of the waste.
DHS would like to point out that pursuant to Section 66305 (b) , and
(c) , in seeking the Department's concurrence with the
nonhazardous waste determination, the waste producer must manage
the waste as hazardous. However, a waste producer may
"self-classify" his waste without the Department's concurrence
.
pr:+'viucc. 1-i's a.itaa$ wig all sampling ..au ::iL_P .:cc.asGyemenc.
requirements for proper waste characterization pursuant to
Section 66694 and all other provisions of Title 22, CCR, in the
handling and/or management of the waste.
If you have any additional questions concerning this matter, please
contact Ron Pilorin of my staff at the letterhead address.
Sincerely,
_5
CL VV"
Stanf d C.
