C The following is an itemized list of hazardous waste violations that have not been addressed for ELON INC as of November 16, 2015. Open violations from November 20, 2014 inspection Violation #102 - Failed to determine if a waste is a hazardous waste or retain waste analysis on site for 3 years. Two large stockpiles were observed in the northern portion of the property, these two stockpiles were also observed the time of inspection conducted on April 15, 2014. The first stockpile, approximately 350 feet wide and 140 feet long was located on the northwestern portion of the site and consisted mostly of concrete rubble and ground -up concrete and possibly asphalt. The second stockpile, approximately 80 feet wide and 190 feet long, was located on the northeastern portion of the site and from visual observations consisted mostly of soil. These stockpiles were approximately 2 to 10 feet in hight. Furthermore, at the time of this inspection it was noted that the concrete stockpile was recently disturbed and two large sections were removed from east and from the west side of the aforementionec stockpile. According to Mr. Machado, he received an approval from Rick Matuska (Community Development Department, code enforcement) to move the concrete offsite. Any person who generates a waste shall determine if the waste is a hazardous waste. This violation was cited on the EHD report dated April 15, 2014, an email statement was received from Mr. Machado on June 2, 2014 indicating that the cement "came from a pipe company in Tracy", n additional information or sampling results concerning the hazardous waste determination has been received by the EHD. Immediately make a hazardous waste determination for both (concrete and soil) stockpiles , and manage then according the Title 22 hazardous waste regulations. Immediately submit a statement and supporting documentation explaining how this waste was managed. This is a Class II violation. Violation #601 - Stored hazardous waste onsite greater than 180 days. Facilities who generate less than 1000 kg of hazardous waste per month and do not exceed 6000 kg of waste stored on site at any time may store waste on site up to 180 days. One 400 -gallon above ground waste oil tank (further described in violation 605) had no accumulation start date. Since it cannot be determined how long the waste has been on site, immediately contact a licensed hazardous waste hauler to dispose of this waste under manifest and submit a copy of the manifest to the EHD. This is a Class II violation. Violation #605 - Failed to completely label containers or tanks of hazardous waste. The 400 -gallon waste oil tank had a blank hazardous waste label. All hazardous waste tanks shall be marked with th words "Hazardous Waste" and the accumulation start date. Immediately ensure that all hazardous waste tanks are marked with the required information.
