C <br />The following is an itemized list of hazardous waste violations that have not been <br />addressed for ELON INC as of November 16, 2015. <br />Open violations from November 20, 2014 inspection <br />Violation #102 - Failed to determine if a waste is a hazardous waste or retain waste analysis on site for 3 <br />years. <br />Two large stockpiles were observed in the northern portion of the property, these two stockpiles were also observed <br />the time of inspection conducted on April 15, 2014. The first stockpile, approximately 350 feet wide and 140 feet long <br />was located on the northwestern portion of the site and consisted mostly of concrete rubble and ground -up concrete <br />and possibly asphalt. The second stockpile, approximately 80 feet wide and 190 feet long, was located on the <br />northeastern portion of the site and from visual observations consisted mostly of soil. These stockpiles were <br />approximately 2 to 10 feet in hight. Furthermore, at the time of this inspection it was noted that the concrete stockpile <br />was recently disturbed and two large sections were removed from east and from the west side of the aforementionec <br />stockpile. According to Mr. Machado, he received an approval from Rick Matuska (Community Development <br />Department, code enforcement) to move the concrete offsite. Any person who generates a waste shall determine if <br />the waste is a hazardous waste. This violation was cited on the EHD report dated April 15, 2014, an email statement <br />was received from Mr. Machado on June 2, 2014 indicating that the cement "came from a pipe company in Tracy", n <br />additional information or sampling results concerning the hazardous waste determination has been received by the <br />EHD. Immediately make a hazardous waste determination for both (concrete and soil) stockpiles , and manage then <br />according the Title 22 hazardous waste regulations. Immediately submit a statement and supporting documentation <br />explaining how this waste was managed. This is a Class II violation. <br />Violation #601 - Stored hazardous waste onsite greater than 180 days. <br />Facilities who generate less than 1000 kg of hazardous waste per month and do not exceed 6000 kg of waste stored <br />on site at any time may store waste on site up to 180 days. One 400 -gallon above ground waste oil tank (further <br />described in violation 605) had no accumulation start date. Since it cannot be determined how long the waste has <br />been on site, immediately contact a licensed hazardous waste hauler to dispose of this waste under manifest and <br />submit a copy of the manifest to the EHD. This is a Class II violation. <br />Violation #605 - Failed to completely label containers or tanks of hazardous waste. <br />The 400 -gallon waste oil tank had a blank hazardous waste label. All hazardous waste tanks shall be marked with th <br />words "Hazardous Waste" and the accumulation start date. Immediately ensure that all hazardous waste tanks are <br />marked with the required information.
