One 400 -gallon waste oil tank had an open fill port and an open funnel inserted in the fill port opening. This tank was observed alongside the 10,000 gallon diesel tank both located inside the secondary containment enclosure adjacent to the southern property boundary. All hazardous waste containers shall be closed at all times except when adding or removing waste. The fill port was closed and the funnel was rend by Mr. Machado at the time of inspection. Ensure that all hazardous waste containers are closed when not adding, far removing waste. This is/a minor violation. CORRECTED. 601 CCR 66262.34(d) Stored hazardous waste onsite greater than 180 days. Facilities who generate less than 1000 kg of hazardous waste per month and do not exceed 6000 kg of waste stored on site at any time may store waste on site up to 180 days. One 400 -gallon above ground waste oil tank (further described in violation 605) had no accumulation start date. Since it cannot be determined how long the waste has been on site, immediately contact a licensed hazardous waste hauler to dispose of this waste under manifest and submit a copy of the manifest to the EHD. This is a Class II violation. 605 CCR 66262.34(f) Failed to completely label containers or tanks of hazardous waste. The 400 -gallon waste oil tank had a blank hazardous waste label. All hazardous waste tanks shall be marked with the words "Hazardous Waste" and the accumulation start date. Immediately ensure that all hazardous waste tanks are marked with the required information. This is a minor violation. Overall Inspection Comments: I This is a follow up inspection report for the follow up inspection conducted by Elena Manzo and Muniappa Naidu of San Joaquin County Environmental Health Department (EHD) on November 20, 2014. The follow-up inspection report was mailed to the facility on December 3, 2014. The initial inspection was conducted on April 15, 2014, the full inspection report was mailed to the facility owner on April 17, 2014. Violation 102 was cited on the initial inspection report, violations 403, 601, and 605 were added based on the follow-up site visit conducted on November 20, 2014. Please be aware that all EHD staff time associated with failing to comply is billed at the current hourly rate ($130). Failure to submit the completed information as required may result in a re -inspection, additional violations, and/or legal action. Consent to perform the inspection and, take photos was given by Mr. Machado, property owner. Immediately complete and submit a copy of the Return to Compliance Certification form to the EHD with a statement documenting the corrective actions for violation 102 (April 15, 2014 inspection report). Furthermore, by January 3, 2015 complete and submit a statement documenting the corrective action and any supporting paperwork for violations 403, 601, and 605 (December 2, 2014 inspection report).
