This tank was <br />observed alongside the 10,000 gallon diesel tank both located inside the secondary containment enclosure adjacent <br />to the southern property boundary. All hazardous waste containers shall be closed at all times except when adding <br />or removing waste. The fill port was closed and the funnel was rend by Mr. Machado at the time of inspection. <br />Ensure that all hazardous waste containers are closed when not adding, far removing waste. This is/a minor violation. <br />CORRECTED. <br />601 CCR 66262.34(d) Stored hazardous waste onsite greater than 180 days. <br />Facilities who generate less than 1000 kg of hazardous waste per month and do not exceed 6000 kg of waste <br />stored on site at any time may store waste on site up to 180 days. One 400 -gallon above ground waste oil tank <br />(further described in violation 605) had no accumulation start date. Since it cannot be determined how long the <br />waste has been on site, immediately contact a licensed hazardous waste hauler to dispose of this waste under <br />manifest and submit a copy of the manifest to the EHD. This is a Class II violation. <br />605 CCR 66262.34(f) Failed to completely label containers or tanks of hazardous waste. <br />The 400 -gallon waste oil tank had a blank hazardous waste label. All hazardous waste tanks shall be marked with <br />the words "Hazardous Waste" and the accumulation start date. Immediately ensure that all hazardous waste tanks <br />are marked with the required information. This is a minor violation. <br />Overall Inspection Comments: I <br />This is a follow up inspection report for the follow up inspection conducted by Elena Manzo and Muniappa Naidu <br />of San Joaquin County Environmental Health Department (EHD) on November 20, 2014. The follow-up inspection <br />report was mailed to the facility on December 3, 2014. The initial inspection was conducted on April 15, 2014, the <br />full inspection report was mailed to the facility owner on April 17, 2014. Violation 102 was cited on the initial <br />inspection report, violations 403, 601, and 605 were added based on the follow-up site visit conducted on <br />November 20, 2014. Please be aware that all EHD staff time associated with failing to comply is billed at the <br />current hourly rate ($130). Failure to submit the completed information as required may result in a re -inspection, <br />additional violations, and/or legal action. <br />Consent to perform the inspection and, take photos was given by Mr. Machado, property owner. <br />Immediately complete and submit a copy of the Return to Compliance Certification form to the EHD with a <br />statement documenting the corrective actions for violation 102 (April 15, 2014 inspection report). Furthermore, by <br />January 3, 2015 complete and submit a statement documenting the corrective action and any supporting <br />paperwork for violations 403, 601, and 605 (December 2, 2014 inspection report). <br />Please be aware as of January 1, 2013, all businesses are required to submit all hazardous materials information <br />online to the California Environmental Reporting System (CERS) at http://cers.calepa.ca.gov.
