4� <br /> Department of Toxic Substances Control <br /> 8800 Cal Center Drive <br /> Terry Tamminen Sacramento, California 95826-3200 Arnold Schwarzenegger <br /> Agency Secretary Governor <br /> Cal/EPA <br /> July 27, 2004 Certified No.: 7000 1670 0007 2729 6679 <br /> Mr. Chris McDougall <br /> Owner/Operator <br /> Attn: Ms. Adrianne Wood <br /> Marina West Marine Services <br /> 6649 Embarcadero Drive <br /> Stockton, California 95219 <br /> VOLUNTARY CLEANUP AGREEMENT, MARINA WEST MARINE SERVICES, <br /> STOCKTON, CALIFORNIA <br /> Dear Mr. McDougall: <br /> The Department of Toxic Substances Control (DTSC) transmitted to you along with a <br /> cover letter dated June 16, 2004 a copy of the fully executed Voluntary Cleanup <br /> Agreement (VCA) signed by you on May 14, 2004 and by DTSC on June 4, 2004. <br /> However, as of July 23, 2004 DTSC does not have a record of receiving advance <br /> payment of the cost estimate for$7,391.00 outlined in Section 3.8.1 of the VCA. The <br /> VCA requires the Proponent to make the advance payment to DTSC no later than ten <br /> (10) days after the VCA is fully executed. <br /> DTSC offered to enter into this expedited version of the VCA with the understanding <br /> that you would cooperate with conducting the necessary investigation and removal <br /> activities, and enter into a VCA with DTSC to review a Preliminary Endangerment <br /> Assessment (PEA) report that would be prepared for the project. A DTSC letter dated <br /> April 20, 2004 (enclosed) received by you outlined the attempts DTSC had previously <br /> made to obtain your signature on the VCA. Based upon this history of lack of response <br /> on the VCA, DTSC requests that the advance payment amount be forwarded to DTSC <br /> within 7 calendar days of receipt of this letter. If the advance payment is not received in <br /> full within 7 calendar days of receipt of this letter, this matter will be referred to the San <br /> Joaquin County District Attorney and Environmental Health offices for follow-up. A copy <br /> of the check that is mailed to the address specified in the VCA should also be faxed to <br /> Mr. Jerry Lile at 916-255-3696 or mailed to him at the address provided at the top of this <br /> correspondence. <br /> Printed on Recycled Paper <br />
