Illegal disposal of hazardous waste is punishable as a felony pursuant to <br /> 2 Health and Safety Code section 25189.5, as a misdemeanor pursuant to section 25190, or by means <br /> 3 of civil penalties pursuant to sections 25189 and 25189.2. <br /> 4 17. Under sections 25189 (c) and(d), any person who intentionally or negligently <br /> 5 disposes of any hazardous waste at an unauthorized location shall be liable for a civil penalty up to <br /> 6 $25,000 for each violation or for each day that the violation continues. Intentional violators face a <br /> 7 minimum penalty of$1,000.00 per day. <br /> 8 18. Alternatively, under section 25189.2 (c), persons who dispose of hazardous <br /> 9 waste at an unauthorized location are strictly liable for civil penalties of up to $25,000.00 for each <br /> 10 violation or for each day that the violation continues. <br /> 11 19. Under section 25189.2 (c) , any person who knows or reasonably should know <br /> 12 that they are transporting a hazardous waste to an unauthorized point for disposal may be punished <br /> 13 by either a felony or misdemeanor conviction, or by civil penalty of up to $25,000.00 for each <br /> 14 violation or for each day the violation continues. <br /> 15 20. California Code of Regulations, Title 22, section 6626.11 requires that a person who <br /> 16 generates a waste, as defined in section 66261.2 shall determine if that waste is a hazardous waste. <br /> 17 21. California Code of Regulations, Title 22, section 6626.34(f)(3) requires that each <br /> 18 container used for onsite accumulation of hazardous waste shall be labeled or clearly marked with <br /> 19 the words "Hazardous Waste". <br /> 20 22. California Code of Regulations,Title 22, section 66265.22 requires that facilities <br /> 21 which store or accumulate hazardous waste maintain a plan which describes measures to be taken in <br /> 22 the event of fire, explosion, or any unplanned sudden or non-sudden release of hazardous waste or <br /> 23 hazardous waste constituents to air, soil,or surface water. <br /> 24 FISH AND GAME LAWS <br /> 25 23. The State of California has enacted a comprehensive statutory program to protect state <br /> 26 water quality in order to preserve the fish and wildlife of this state and the riparian habitat upon <br /> 27 which fish and wildlife depend for their continued existence. <br /> .28 <br /> 4. <br />
