The manager stated that the liquid was <br />a waste. <br />One gallon container labeled "Extreme Hi -Gloss 340 Enamel' was found in the trash. During the inspection the <br />manager said that the container was still in use and took the item out of the trash and placed it in the storage area. <br />Any person who generates a waste shall determine if the waste is a hazardous waste. Immediately, make a <br />hazardous waste determination for the yellow liquid, and manage it according to Title 22 hazardous waste <br />regulations. Submit a statement and supporting documentation explaining how this waste was managed. <br />This is a Class II violation. <br />106 <br />CCR 66262.34(d)(2) Failed to train employees on waste handling and emergency procedures. <br />On 11/13/2017, on manifest 3142288, Forward Landfill received 9 tons of lime waste with a pH of 12.8. According <br />to Joseph Lipka, environmental manager, the special waste department (Republic) in Arizona reviews lab analyticals <br />to make a determination on if the waste can be accepted at Forward Landfill, a class 2 landfill. Per Joseph, this <br />department uses a template to assist in making the determination. The template used in making the determination <br />was outdated and allowed for the acceptance of a hazardous waste with a pH higher than 12.5. According to <br />Joseph, this template has been updated. <br />The generator must ensure that all employees who handle hazardous waste are thoroughly familiar with proper <br />waste handling and emergency procedures. <br />Provide proof of training and a copy of the training material for the employees in the special waste handling <br />department to the EHD. <br />In addition, provide a copy of the outdated template and the updated template to the EHD. <br />This is a Class 11 violation. <br />202 <br />HSC 25189.5(a) Disposed or caused disposal of HW at an unauthorized point. <br />On 11/13/2017, on manifest 3142288, Forward Landfill received 9 tons of lime waste with a pH of 12.8. <br />On multiple occasions between April 2014 -December 2015, Forward Landfill accepted waste from Woodland <br />Biomass containing hazardous waste levels of copper. Per notice of violation from the Central Valley Regional <br />Water Quality Control Board dated 6/20/2016, Forward Landfill received hazardous waste during the following <br />quarters: <br />2nd Quarter 2014: 48mg/1, 3rd Quarter 2014: 43 mg/l, 2nd Quarter 2015: 40mg/l, 2nd Quarter 2015: 31 mg/I, 3rd <br />Quarter 2015: 82 mg/l, 4th Quarter 2015: 31 mg/l, 4th Quarter 2015: 32 mg/l. <br />Hazardous wastes shall be disposed of only by transportation to a permitted hazardous waste treatment, storage, <br />and disposal facility (TSDF). Immediately cease disposal of hazardous waste at an unpermitted TSDF and ensure <br />that all future waste is hauled by a licensed hazardous waste transporter to a permitted TSDF. <br />Within 30 days provide to the EHD written procedures to ensure hazardous waste is no longer accepted at this <br />facility. <br />This is a Class I violation. <br />FA0007101 PRO505948 SCO01 06/14/2018 <br />EHD 22-01 Rev. 09/22/16 Page 4 of 7 Small Quantity Hazardous Waste Generator OIR <br />
