Mr. Morris L. Allen
May 30, 1995
Page 2
Treatment by dilution is not prohibited by the HWCL or
regulations promulgated thereunder except where it is used as a
mea,ns to achieve or evade land disposal restrictions in Title 22
California Code of Regulations Division 4 . 5, Chapter 18 . See
specifically 22 CCR § 66268 .3 . The land disposal restrictions
however, are not applicable to the wastes being discharged to the
sanitary sewer.
The "mixture rule" would also apply to the mixing of the
hazardous characteristic groundwater from well A8 with the
noncharacteristic groundwater to make the mixture nonhazardous .
Where a characteristic hazardous waste is mixed with another waste,
and the resulting waste mixture no longer exhibits a
characteristic, then that resulting mixture is not
characteristically hazardous . 22 CCR §66261. 3 (b) (3) and (d) .
Because the blending or mixing of groundwater from the two
wells is not prohibited under the HWCL or regulations promulgated
thereunder, there would be no prohibition on the discharge of this
groundwater into the sanitary sewer unless the groundwater at the
point it was discharged into the sanitary sewer was a hazardous
waste under Title 22 CCR Division 4 . 5, Chapter 11 .
Feel free to give me a call at (916) 324-0556 if you should
have any questions regarding these issues .
Sincerely,
ROBERT P. HOFFMAN
Chief Counsel
Richard W. Sherwood
Senior Staff Counsel
cc: Mr. Bart J.
