This waste is being disposed of as <br /> non-hazardous waste. A generator shall make a hazardous waste determination and keep a record of any test results, <br /> waste analyses, or other determinations made in accordance with hazardous waste regulations for at least three years <br /> from the date that the waste was last disposed of. Immediately locate a copy of the waste analysis conducted for the <br /> wash rack waste and submit a copy to the EHD. If a copy is unavailable, immediately make a hazardous waste <br /> determination and begin managing the wash rack soil/sludge under Title 22 hazardous waste regulations. This is a <br /> repeat violation, Class 11. <br /> 110 CCR 66265.16(a-c) Failed to train employees and maintain records on waste handling and emergency procedures. <br /> According to the training records on site, Jeff Hughes, Mike Fouts, and Rodney Dirks did not receive the mandatory <br /> "Hazardous Waste- EMS- Spill Response"training, which was due in April 2014. Personnel who handle hazardous <br /> waste shall be trained within six months of assignment and take part in an annual review of the initial training received. <br /> At a minimum, the training program shall be designed to ensure that facility personnel are able to respond effectively to <br /> emergencies by familiarizing them with emergency procedures, emergency equipment, and emergency systems, <br /> including where applicable: <br /> 1. procedures for using, inspecting, repairing, and replacing facility emergency and monitoring equipment; <br /> 2. key parameters for automatic waste feed cut-off systems; <br /> 3. communications or alarm systems; <br /> 4. response to fires or explosions; <br /> 5. response to ground-water contamination incidents; and <br /> 6. shutdown of operations. <br /> The owner or operator shall maintain the following documents and records at the facility: <br /> 1. the job title for each position at the facility related to hazardous waste management, and the name of each <br /> employee filling each job; <br /> 2. written job description for each position listed above; <br /> 3. written description of the type and amount of both introductory and continuing training that will be given to each <br /> person filing positions listed above; <br /> 4. records that document that the training has been given to and completed by facility personnel. <br /> Training records on current employees shall be kept until closure of the facility. Training records on former employees <br /> shall be kept for at least three years from the date the employee last worked at the facility. Immediately provide <br /> employees with initial or refresher hazardous waste training. Submit a copy of the updated records to the EHD.
