(8) The hauler shall 10mit all copies of the manifest to the d ated facility. A representative of the <br />designated facility which receives the used oil shall sign and date the manifest, return two copies to the hauler, retain <br />one copy, and send the original to the department within 30 days. <br />(9) All other manifesting requirements of Sections 25160 and 25161 shall be complied with unless specifically <br />exempted under this subdivision. <br />(Amended by Stats. 1988, Ch. 545.) <br />25250.10. Every registered hazardous waste hauler who transports used oil shall report to the department on or <br />before March 1 of each year, the following information on a form provided by the department: <br />(a) The shipping descriptions of used oil transported during the preceding year. <br />(b) The volume of each type of used oil transported, identified by shipping description. <br />(c) The facilities to which the used oil was transported, identified by name, address, telephone number, and <br />Environmental Protection Agency identification number. <br />(Amended by Stats. 1988, Ch. 545.) <br />25250.11. (a) Any person who receives used oil from consumers or other used oil generators, is exempt from <br />hazardous waste facility permit requirements imposed pursuant to Article 9 (commencing with Section 25200) with <br />respect to any location at which used oil is received if all of the following conditions are met: <br />(1) Each shipment of used oil received does not exceed 20 gallons, and the contents of any single container does <br />not exceed five gallons. <br />(2) No other hazardous wastes are received at the location, unless authorized by other provisions of law. <br />(3) The used oil is transported by the generator of the used oil. <br />(b) Any person who transports used oil is exempt from the requirements of subdivision (a) and (e) of Section <br />25163 and from the requirements of Section 25160 concerning the possession of a manifest while transporting used <br />oil to a location described in subdivision (a) if all of the following conditions are met: <br />(1) The contents of any single container do not exceed five gallons. <br />(2) Each shipment of used oil does not exceed 20 gallons. <br />(3) The person transporting the used oil had generated the oil. <br />(Amended by Stats. 1990, Ch. 1219) <br />25250.12. (a) Used oil generated during maintenance operations may be transferred from its point of generation <br />to the maintenance person's place of business, other than a residence, for the purpose of consolidation in a tank or <br />container, without meeting the requirements of Sections 25160, 25163, and 25201, if the material is to be recycled at <br />an authorized offsite hazardous waste facility and if all the following conditions are met: <br />(1) Not more than 70 gallons are transferred in the vehicle at any one time. <br />(2) The used oil is managed in accordance with all laws concerning storage and handling of hazardous wastes upon <br />consolidation at the maintenance person's place of business. <br />(3) The used oil is deemed to be generated at the point of consolidation upon consolidation. <br />(Added by Stats. 1990, Ch. 1219) <br />25250.15. (a) Any person operating a refuse removal vehicle or a curbside collection vehicle used to collect or <br />transport used oil which has been generated as a household waste or as part of a curbside recycling program, as defined <br />by the board, is exempt from the requirements of Sections 25160 and 25250.8, and subdivisions (a) and (e) of Section <br />25163 of this code and Chapter 2.5 (commencing with Section 2500) of Division 2, Division 14.1 (commencing with <br />Section 32000), and subdivision (g) of Section 34500 of the Vehicle Code. <br />(b) Refuse removal and other curbside collection operations exempted under subdivision (a) are also exempt from <br />permit requirements pursuant to Article 9 (commencing with Section 25200), if the storage location meets all <br />applicable hazardous waste generator, container, and tank requirements, except for the generator fee requirement <br />specified in subdivision (d). <br />(c) Used oil collected under the requirements of this section shall be deemed to be generated by the storage <br />location upon receipt. <br />(d) Used oil collected pursuant to this section is exempt from the generator fee imposed pursuant to Section <br />25205.5. <br />(Amended by Stats. 1991, Ch. 1173) <br />25250.16. No person may recycle used oil without obtaining authorization from the department pursuant to <br />Section 25200 or 25200.5, or unless exempted pursuant to Section 25143.2. <br />(Amended by stats. 1989, Ch. 1254.) <br />159 <br />
