0 6 <br /> Inspection response letter dated April 24,2003,to your department. Additionally,this <br /> facility does have within its Compliance binder a Monitoring and Response Plan that lists <br /> the type of line leak detection for each tank. I am enclosing an updated Monitoring& <br /> Response Plan which lists the type of overfill prevention equipment that you requested in <br /> your Inspection report. <br /> 2.Alleged Violation: The UST Program Inspection Report stated, "#11, The piping <br /> transition sump#I (south)had approximately I gallon of fuel in it and the sensor was <br /> located in the middle of the sump so the leak was not detected. Always maintain <br /> monitoring equipment at the lowest possible point to detect a leak at the earliest possible <br /> opportunity.—Technician corrected sensor this day." In the corresponding Violation <br /> checklist,a check was placed next to"CCR 2630(d),UST system monitoring equipment <br /> is properly located to detect a leak." <br /> Response: BP understands this transition sump to be an oval shape with dimensions of <br /> approximately 24 inches in diameter and a flat bottom. Technician indicates he moved <br /> the sensor to a side of the sump on your direction. Additionally,BP ,performed a <br /> precision line test at this facility on 5/10/2005,with results indicating a 'tight' system. BP <br /> believes that liquid substance found in transition sump was mostly rain water, due to <br /> recent rain. <br /> 3.Alleged Violation: The UST Program Inspection Report stated, "#14,Approximately <br /> 1 gallon of fuel was found in the piping transition sump#1 (south). Investigate and <br /> perform necessary tests to determine the cause of the release. Monitor sump for easy <br /> detection. Submit findings to this office by 5/20/05."In the corresponding Violation <br /> checklist, a check was placed next to "CCR 2631 (f) (1),primary containment is product <br /> tight." <br /> Response: Included with this letter are the test results from the precision line test <br /> performed on May 10,2005. Test results indicate a'product tight' system, which leads <br /> BP to believe that liquid found in transition sump was primarily water and not related to a <br /> release. This water was removed by the technician during the inspection and placed into a <br /> properly labeled Hazardous waste drum on site. <br /> Additionally,the UST program inspection report noted, "this facility is subject to re- <br /> inspection billed at EHD's hourly rate. Submit return to compliance by 5/20/05." <br /> Enclosed with this letter is the annual Monitoring system certification, line leak detector <br /> test data sheets, and the spill/overfill containment test data sheets for the Arco facility <br /> listed above. <br /> With the transmittal of this letter, it is our understanding that the above-mentioned <br /> alleged violations associated with this routine inspection conducted on April 20, 2005 <br /> have been resolved. If this is not correct,please contact me as soon as possible. If you <br /> have any questions regarding the enclosed documents, or if fin-ther action is required by <br /> BP/ARCO,please contact me at(800)525-5857 x6233. <br />
