In determining whether a violation is <br />chronic or a violator is recalcitrant, the local agency shall consider whether there is evidence indicating that the <br />violator has engaged in a pattern of neglect or disregard with respect to any requirement in Title 23 (not including <br />corrective action). <br />On June 9, 2016, the San Joaquin County Environmental Health Department (EHD) issued a new owner <br />consultation letter (sent via certified mail) to Mr. Fahmi Al Sumeri, to date no required documentatior <br />associated with the ownership change has been submitted to the EHD. In addition, no required routine <br />secondary containment testing and monitoring system certification testing has been conducted (CCR 2637, <br />CCR 2638 (a) HSC 25284.2); also this facility hasn't been operational in many months and no requirec <br />temporary closure documentation has been submitted (HSC 25298). <br />No person may own or operate an underground storage tank unless a permit for its operation has been issue <br />by the local agency to the owner or operator of the tank (HSC 25284(a)(1)). Any person assuming ownershi <br />of an underground storage tank used for the storage of hazardous substances for which a valid operatin <br />permit has been issued shall have 30 days from the date of assumption of ownership to apply for an operatin <br />permit pursuant to Section 25286 (HSC 25284).
