In determining whether a violation is chronic or a violator is recalcitrant, the local agency shall consider whether there is evidence indicating that the violator has engaged in a pattern of neglect or disregard with respect to any requirement in Title 23 (not including corrective action). On June 9, 2016, the San Joaquin County Environmental Health Department (EHD) issued a new owner consultation letter (sent via certified mail) to Mr. Fahmi Al Sumeri, to date no required documentatior associated with the ownership change has been submitted to the EHD. In addition, no required routine secondary containment testing and monitoring system certification testing has been conducted (CCR 2637, CCR 2638 (a) HSC 25284.2); also this facility hasn't been operational in many months and no requirec temporary closure documentation has been submitted (HSC 25298). No person may own or operate an underground storage tank unless a permit for its operation has been issue by the local agency to the owner or operator of the tank (HSC 25284(a)(1)). Any person assuming ownershi of an underground storage tank used for the storage of hazardous substances for which a valid operatin permit has been issued shall have 30 days from the date of assumption of ownership to apply for an operatin permit pursuant to Section 25286 (HSC 25284). A notice to abate was issued on 5-1-2017, to date the site i still out of compliance, the site shall be brought into compliance to avoid being red tagged on 5-18-2017.
