ID#: —T <br /> Type of significant violation: <br /> • A violation that is causing, or threatens to cause a liquid release of petroleum from an underground storage tank <br /> system, including, but not limited to: the failure of any required overfill prevention system, where the failure is <br /> causing or threatens to cause a release; or the failure of a required spill containment structure, where the failure is <br /> causing or threatens to cause a release to the environment due to a spill or an overfill. <br /> • A violation that impairs the ability of an underground storage tank system to detect a liquid leak or contain a liquid <br /> release of petroleum in the manner required by law. <br /> ❑x A chronic violation or a violation that is committed by a recalcitrant violator. In determining whether a violation is <br /> chronic or a violator is recalcitrant, the local agency shall consider whether there is evidence indicating that the <br /> violator has engaged in a pattern of neglect or disregard with respect to any requirement in Title 23 (not including <br /> corrective action). <br /> On June 9, 2016, the San Joaquin County Environmental Health Department(EHD) issued a new owner <br /> consultation letter(sent via certified mail) to Mr. Fahmi Al Sumeri, to date no required documentation <br /> associated with the ownership change has been submitted to the EHD. In addition, no required routine <br /> secondary containment testing and monitoring system certification testing has been conducted (Title 23 California <br /> Code of Regulations (CCR) section 2637, CCR 2638 (a), California Health & Safety Code (HSC) section 25284.2); <br /> also this facility hasn't been operational in many months and no required temporary closure documentation has <br /> been submitted (HSC 25298). No person may own or operate an underground storage tank unless a permit for its <br /> operation has been issued by the local agency to the owner or operator of the tank (HSC 25284(a)( 1 )). Any person <br /> assuming ownership of an underground storage tank used for the storage of hazardous substances for which a <br /> valid operating permit has been issued shall have 30 days from the date of assumption of ownership to apply for an <br /> operating permit pursuant to HSC Section 25286 (HSC 25284). <br /> A notice to abate was issued on May 1, 2017, a notice of significant violation was issued May 11, 2017 and to date <br /> the site is still out of compliance and is selling fuel. Immediately schedule the required testing and obtain an operating <br /> permit from the EHD.
