Weber Avenue, Third Floor <br /> Stockton, CA 95201-0388 <br /> RE : Tosco Facility#05448 <br /> 3202 West Hammer Lane <br /> Stockton, CA <br /> Dear Mr. Kith : <br /> On September 2, 1998, I left you a message regarding your 8/28/98 UST Inspection Report at the <br /> subject facility. Doug Wilson indicated that you received my message,but I have not heard back <br /> from you as of this writing. In order to correct some of the deficiencies identified during your <br /> inspection, I offer the following : <br /> 1. Maintenance records were provided by Elite IV and distributed to the site on September 4, <br /> 1998 for your review. <br /> 2. Monitoring records are maintained on a daily basis and stored at the facility for six months. <br /> Upon your re-inspection,you will be able to review these records. Randy Halter,the District <br /> Manager for this facility, will make sure these records are readily available. <br /> 3. A written monitoring plan for the site is attached and copies are available at the site. <br /> 4. A written response plan for the site is attached and copies are available at the site. <br /> 5. Overfill containment was installed at this facility during either BP or Mobil ownership. <br /> Tosco was never provided copies of EHD permits to install the overfill containment from the <br /> previous owners. Therefore,please forward to me the necessary permit applications so I can <br /> resolve this issue. <br /> 6. All overfill containers were recently serviced by Elite IV. The standing gasoline was placed <br /> back into the underground storage tanks. In the future, the Store Manager has been <br /> instructed to periodically inspect the overfill containers to ensure that they stay free of <br /> gasoline and debris. <br /> 7. The TLS-350 monitor does not perform a monthly 0.2 gph leak test on the tanks. The TLS- <br /> 350 is merely acting at a tank gauge and not an automatic tank gauge. The tanks are <br /> currently monitored by SIR and an annual tank test. Attached please find an annual SIR <br /> summary and the most recent tank and line test. <br /> 8. An annual ATG summary report is not applicable since there is no automatic tank gauge. <br /> Tosco recognizes that the facility does not meet the 1998 upgrade requirements. As you are <br /> aware, Tosco is waiting for approval from your agency to perform the necessary upgrade work. <br />
