<br />The permit of your Underground Storage Tank (UST) at the above referenced site will
<br />not be issued due to not meeting the requirements of California Code of Regulation
<br />(CCR), Title 23, Division 3, Chapter 16, Section 2637.
<br />San Joaquin County Environmental Health Department (SJC-EHD) had received and
<br />reviewed the above referenced facility secondary containment test results. It has been
<br />noted that the piping interstitial has not been tested as required. Further review of our
<br />UST file indicates that a trench line system was installed in 1988. The State Water
<br />Resources Control Board had indicated that the trench line systems are not testable.
<br />CCR, Title 23, Division 3, Chapter 16, Section 2637 (a)(1) further requires that "By
<br />December 31, 2002, the owner or operator of any secondary containment system that the owner or
<br />operator determines cannot be tested in accordance with this section shall replace the" secondary
<br />containment system with a system that can be tested in accordance with this section...
<br />California Health and Safety Code, Section 25284 states that "no person may own or operate
<br />an underground storage tank unless a permit for its operation has been issued by the local agency to the
<br />owner or operator of the tank, or a unified program facility permit has been issued by the local agency to
<br />the owner or operator of the unified program facility on which the tank is located."
<br />The above piping system must be replaced under permit from SJC-EHD. Please note that
<br />operation of this system is a violation of the above sections and each day is a considered
<br />separate violation.
