The monitoring plan on site and on file states "Overfill prevention is set at 90% of the tank <br />capacity." The overfill prevention at this site is mechanical flappers set at 95%. No external alarm was <br />observed on site. The monitoring and response plans must be current and approved by the EHD. <br />Complete and submit a copy of the revised monitoring plan for approval by the EHD by March 1, 2013. <br />An approved copy will be returned for your records. <br />REPEAT VIOLATION <br />305. The 91 STP sump sensor failed to activate an audible and visual alarm when tested to ensure <br />continuous monitoring of the tank system. All monitoring equipment shall be maintained to activate an <br />audible and visual alarm or stop the flow of product at the dispenser when it detects a leak. The sensor <br />was replaced and retested during the inspection. <br />REPEAT VIOLATION <br />310. Liquid was observed in the 91 fill sump. If water could enter into the secondary containment by <br />precipitation or infiltration, it must be removed and disposed of properly. The liquid was removed by the <br />technician at the time of inspection. Ensure that the sumps are maintained free of liquid. <br />REPEAT VIOLATION <br />Complete and submit a copy of the Return to Compliance Certification form to the EHD by March 1, <br />2013 along with a statement documenting the corrective actions that have been or will be taken for each <br />violation, and any supporting paperwork. <br />Provided, Return to Compliance Certification form <br />ALL EHD STAFF TIME ASSOCIATED WITH FAILING TO COMPLY BY THE ABOVE NOTED DATES WILL BE BILLED AT THE CURRENT HOURLY RATE. <br />THIS FACILITY IS SUBJECT TO REINS CTION AT ANY TIME AT EHD'S CURRENT HOURLY RATE. <br />
