Box 990 <br /> Stockton, CA 95201 <br /> RE: The People vs James Ramsey, John Guinta, et al <br /> Court Case No. 271126 <br /> Dear Mr. Irey: <br /> A copy of Ron Rowe's letter of October 1, 1997 directed to Frank Guinta and James <br /> Ramsey has been forwarded to me. We have passed along this information to Remedy, Inc., who <br /> is putting together our site remediation plan and will be prepared to comment on the material <br /> contained in the Rowe letter at the time of our scheduled meeting. <br /> I want to take the time to point out that we do not concede or believe that there is an <br /> "unauthorized release" present at the site. Mr. Rowe's letter seems to presuppose such a release <br /> based upon the presence of MTBE. Based upon our own independent investigation, we believe <br /> that the evidence is that the MTBE that is shown in the soil test that we provided to you has <br /> actually been present since before the 1995 tests ordered by Bank of Stockton. <br /> In any event, we are now in possession of a Letter Of Commitment from State Fund to <br /> allow us to begin the remediation process. The arrival of the LOC also allows us to begin the <br /> financing of tank replacement and other site upgrades. All of this will, of course, take some time <br /> and I am sure that at our meeting next week we will be able to address the specific. time frames <br /> for putting together and implementing a comprehensive cleanup and upgrade plan. <br /> Very truly yours, <br /> THE STI FI <br /> J S D.
