<br /> UNDERGROUND STORAGE TANKS(UST)OWNER/OPERATOR AGREEMENT
<br /> California Underground Storage Tank Regulations(CCR,Title 23,Division 3,Chapter 16,Article 2,Section 2620(b)),require
<br /> Suncor Holdings-COPA,LLC,(the tank owner)to execute a written agreement with their Dealers,(the tank operators),requiring
<br /> them to monitor the underground storage tanks(USTs)containing hazardous substances.
<br /> PART I:OWNER CERTIFICATION
<br /> Suncor Holdings-COPII,LLC,us owner of the USTs at the above site,certifies that:
<br /> I. It is not the tank operator of the USTs at said site.
<br /> 2. It has applied for the UST permit,and a valid UST permit is on-site or will be delivered to the tank operator when
<br /> received from the local implementing agency.
<br /> 3. It will notify the local implementing agency of any operator change within thirty(30)days of any such change.
<br /> 4. Both Suncor Holdings-COPII,LLC and the operator have signed this Agreement.
<br /> PART II:OPERATOR CERTIFICATION
<br /> The law requires the tank operator of USTs containing motor vehicle fuel to comply with the following standards:
<br /> 1. A valid UST permit shall be maintained on site.
<br /> 2. A UST Monitoring Program,approved by the local implementing agency,must be implemented.
<br /> 3. A Spill Response Plan,approved by the local implementing agency,must be implemented.
<br /> 4. The requirements stipulated in the UST Monitoring Program and Spill Response Plan(attached),must be complied
<br /> with. This shall include,if necessary,the submittal of an annual written statement to the local implementing agency,
<br /> verifying under penalty of perjury that all monthly monitoring reports were summarized,and that all data contained
<br /> within the monitoring reports are within allowable variations. Alternatively,a listing of the times,dates and
<br /> corresponding monitoring report data that exceeded the allowable variations must be provided.
<br /> 5. The monitoring and maintenance records must be maintained. This includes inventory readings and reconciliation
<br /> records,sampling and testing results,all of which must be maintained on-site for at least 3 years,or in an approved
<br /> off-site location. Said records must be made available upon request,within 36 hours,to the local implementing
<br /> agency or the State Water Board.
<br /> 6. Records must be kept in sufficient detail to enable the local implementing agency,at any time,to determine that the
<br /> tank operator has undertaken all monitoring activities required by the UST Permit to Operate and/or the UST
<br /> Monitoring Program.
<br /> 7. Suncor Holdings-COPII,LLC must be notified of the detection of any unauthorized releases by the fastest means
<br /> available(no later than 8 hours)or within the time frame mandated by the local implementing agency. The operator
<br /> must adhere to the procedures contained in the Spill Response Plan. Suncor Holdings-COPII,LLC will notify the
<br /> appropriate agency(s)and submit a written report as may be required by the agency(s).
<br /> 8. Daily inventory measurements must be performed by a trained facility operator or designated facility personnel for
<br /> each day the facility is in operation.
<br /> 9. Suncor Holdings-COPII,LLC must be notified of any malfunction of the UST monitoring system. The monitoring
<br /> equipment shall be operated and maintained in accordance with the regulation per Title 023,Division 3,Chapter 16,
<br /> Article 4,Section 2641 (i)of the California Code of Regulation.
<br /> 10. Review and comply with all applicable Federal,State,and local regulations.
