In determining whether a violation is <br />chronic or a violator is recalcitrant, the local agency shall consider whether there is evidence indicating that the <br />violator has engaged in a pattern of neglect or disregard with respect to any requirement in Title 23 (not including <br />corrective action). <br />The secondary containment testing results from December 19-20, 2012 indicated a failure at UDC 3/4 and UDC 5/6. Tc <br />date no repairs to the secondary containment or testing of the secondary containment was conducted at this facility. Th( <br />underground storage tank system must be operated to prevent unauthorized releases, and all secondary containment fo <br />the UST system must be tight. <br />An initial letter of "Notice of Significant Violation" was issued on February 17, 2015 requesting the secondary containmi <br />repairs to be completed by March 20, 2015 or the underground storage tanks (UST) may be Red -Tagged. To d, <br />secondary containment repairs were conducted, and a Red Tag has been affixed to the fill -pipe of all USTs today <br />accordance to California Code of Regulations (CCR) Section 2717-2717.7. <br />Fuel delivery to the tanks is prohibited. Red Tag will be removed by the EHD after the violation referenced in the above- <br />mentioned "Notice of Significant Violation" has been corrected.
