In determining whether a violation is <br /> chronic or a violator is recalcitrant, the local agency shall consider whether there is evidence indicating that the <br /> violator has engaged in a pattern of neglect or disregard with respect to any requirement in Title 23 (not including <br /> corrective action). <br /> Failed to demonstrate the UST system is operating to prevent unauthorized release in accordance to <br /> HSC 25292.1. There is currently no line leak detection for the diesel fuel line in accordance with <br /> CCR 2636(0(2). There is no positive shutdown or fail safe to the diesel and 91-octane pumps at <br /> Dispenser#3/4, and no annual line test as required by CCR 2636(f)(4).
