A violation that impairs the ability of an underground storage tank system to detect a liquid leak or contain a liquid release of petroleum in the manner required by law. I@ A chronic violation or a violation that is committed by a recalcitrant violator. In determining whether a violation is chronic or a violator is recalcitrant, the local agency shall consider whether there is evidence indicating that the violator has engaged in a pattern of neglect or disregard with respect to any requirement in Title 23 (not including corrective action). Failed to demonstrate the UST system is operating to prevent unauthorized release in accordance to HSC 25292.1. There is currently no line leak detection for the diesel fuel line in accordance with CCR 2636(0(2). There is no positive shutdown or fail safe to the diesel and 91-octane pumps at Dispenser#3/4, and no annual line test as required by CCR 2636(f)(4). Immediately provide line leak detection to the diesel fuel line, and provide positive shutdown to the diesel and 91-octane pumps at Dispenser#3/4, or conduct either annual line test. Please be aware failure to comply may result in EHD affixing a Red Tag to the fill pipes of the UST system in seven (7) business days in accordance to HSC Section 25292.3 and CCR Section 2717-2717.7 Please beware this and future enforcement action is billable at current EHD hourly rate.
