application. Since he just received the plans yesterday, work cannot proceed until he approves the <br /> plans. Another concern with the EVR upgrade and the store expansion is the fact that the vent piping that come <br /> from all of the UST's are located along the west side of the building adjacent to the waste oil UST. If the vent <br /> piping needs to be relocated because of the building expansion, an amendment to the approved permit <br /> application must submitted as well as a plan of the new location for the vent piping. <br /> Several other issues need to be resolved as outlined in the UST Official Inspection Report from July 5, 2012 <br /> that was issued to and received by ABC Petroleum Inc., in the Notice to Abate from Nov. 1, 2012 that was <br /> issued and received by ABC Petroleum Inc., and again in the UST follow up letter from Nov. 6, 2012 that was <br /> issued to and received by ABC Petroleum Inc.: <br /> 1. Annual Monitoring System Certification—The last certification was performed on June 30, <br /> 2008. This certification is required before the UST system can be approved to operate. <br /> 2. Spill Container Testing—The last certification was performed on June 30, 2008. This <br /> certification is required before the UST system can be approved to operate. <br /> 3. Secondary Containment Testing—The last test was conducted on October 22, 2004. This <br /> testing is required every three years. It is over eight years past due and must be completed before the <br /> UST System can be approved to operate. <br /> 4. Enhanced Leak Detection (ELD)—The testis required since the UST are located within 1000 <br /> feet of a public water system. A permit application is required to be submitted to install the <br /> Enhanced Leak Detection from our department. A letter was sent on June 20, 2007 to this UST <br /> facility from the CA State Water Resources Control Board informing of the requirement. The <br /> Enhanced Leak Detection Test must be performed and the UST System must receiving a passing test <br /> result for all of the components that will be tested before the UST System can be approved to <br /> operate. <br /> 5. CA Board of Equalization number-A BOE number is required to be submitted to our <br /> department. <br /> 6. CA Environmental Reporting System (CERS)—All businesses are required to use this database, <br /> as of Jan. 1, 2013, to submit information in regards to the Hazardous Materials Business Plan, <br /> Hazardous Waste Generation, Underground Storage Tank information. All of the required <br /> information from the listed programs must be submitted for review by our department into the <br /> CERS. The submittal elements for all of the listed elements must be approved before the UST <br /> System can be approved to operate. <br /> Please submit in writing, a corrective action statement for the above issues/questions with a timeframe for <br /> achieving completion by March 29, 2013. A corrective action statement had been received from ABC <br /> Petroleum on Nov. 29, 2012. What is the proposed date that this facility will be in operation, once the building <br /> remodel is completed? Some of the tests listed above can be completed without the UST's having fuel stored <br /> inside. What is a reasonable expectation for getting some of the tests completed before the store is opened? A <br /> 5 <br />
