The last manifest (10/26/07) for hazardous waste pickup is enclosed. Any <br />older manifests should have been located in Tab 2 of the onsite <br />"Hazardous Materials Regulatory Compliance Documents" binder (red <br />coversheet). <br />2. The max product alarm on 5/8/08 in the 87 octane tank is valid according <br />to our delivery records. Failure to record the alarm by the Designated <br />Operator appears to have been an oversight. A fact, not intended to be an <br />exoneration for overfilling, is that this site's tanks, as well as tanks at all <br />Quik Stop fueling facilities, provide secondary containment around all <br />service penetrations (fittings, bungs) to the primary containment, making it <br />virtually impossible for an overfill to result in a release, unless, of course, <br />an overfill results in a surface spill. <br />3. There is no provision, procedural or otherwise, to manually override the <br />overfill prevention device. However, that does not mean that the <br />equipment cannot be illegally defeated. Our carrier has been warned to <br />estimate loads so that fuel deliveries do not result in overfilling. <br />4. A signed Return to Compliance Certification is enclosed. <br />
