I Joaquin and elsewhere in the State of California. <br />2 3. Defendant, in the course of Defendant's HOSPITAL activities is, pursuant to Health and <br />3 Safety Code section 25280 et seq., hereby permanently enjoined from: <br />4 a. Failing to annually test the spill containment structure, in violation of Health and <br />5 Safety Code section 25284.2; <br />6 b. Failing to prevent structural weakening of secondary containment, in violation of <br />7 Health and Safety Code section 25291(a)(2); <br />8 c. Failing to maintain monitoring system for water intrusion and for removing the <br />9 water, in violation of Health and Safety Code section 25291(e); <br />10 d. Failing to implement a monitoring program approved by the local agency and <br />11 specified in the underground storage tank operating permit, in violation of California Code of <br />12 Regulations, title 23 section 2632(b); <br />13 e. Failing to conduct monitoring on all underground pressurized piping with <br />14 secondary containment annually, in violation of California Code of Regulations, title 23 section <br />15 2636(f)(4); <br />16 f. Failing to perform periodic testing of secondary containment system, in violation of <br />17 California Code of Regulations, title 23 section 2637(a); <br />18 g. Failing to submit a completed Monitoring System Certification form to the local <br />19 agency, in violation of California Code of Regulations, title 23 section 2638(d); <br />20 h. Failing to demonstrate to the satisfaction of the local agency that the conditions and <br />21 requirements specified in subsection 2660(k) will be met before upgrading an underground storage <br />22 tank system, in violation California Code of Regulations, title 23 section 2662(a); <br />23 i. Failing to retain a copy of the permit and all conditions and attachments, including <br />24 monitoring plans at the facility, in violation of California Code of Regulations, title 23 section <br />25 2712(i); <br />26 j. Failing to record results of each inspection by the designated underground storage <br />27 tank operator in a monthly inspection report, in violation of California Code of Regulations, title 23 <br />28 section 2715(c); <br />2 <br />Q PERMANENT INJUNCTION AND FINAL JUDGMENT PURSUANT TO STIPULATION <br />
