1 b. TWELVE THOUSAND FIVE HUNDRED DOLLARS ($12,500.00) payable to the <br />2 CUPA Forum Environmental Protection Trust Fund to be used for the purpose of enhancing the <br />3 investigation, inspection and enforcement of Unified Programs throughout the State of California; <br />4 c. TWELVE THOUSAND FIVE HUNDRED DOLLARS ($12,500.00) payable to the <br />5 California Hazardous Materials Investigators Association (CHMIA) for enforcement training <br />6 programs. The entire TWELVE THOUSAND FIVE HUNDRED DOLLARS ($12,500.00) shall be <br />7 used by CHMIA to assist the Western States Project in improving the training facilities in <br />8 conjunction with California Specialized Training Institute (CSTI) for the Advanced Environmental <br />9 Criminal Training Program (AECTP) courses. <br />10 8. Defendant shall additionally pay to Plaintiff the sum of SIX THOUSAND SEVEN <br />11 HUNDRED TEN DOLLARS ($6,710.00) as partial recovery of the cost of investigation and suit <br />12 incurred by the SAN JOAQUIN COUNTY ENVIRONMENTAL HEALTH DEPARTMENT. Said <br />13 payment shall be due anda�yable to the aforementioned agency, and shall be delivered to the San <br />14 Joaquin County Office of the District Attorney, Environmental Prosecutions Unit, at time of signing. <br />15 9. Defendant shall additionally pay to Plaintiff the sum of FOUR THOUSAND DOLLARS <br />16 ($4,000.00) as partial recovery of the cost of investigation and suit incurred by the San Joaquin <br />17 County Office of the District Attorney. Said payment shall be due and ga bya leto the aforementioned <br />18 agency, and shall be delivered to the San Joaquin County .Office of the District Attorney, <br />19 Environmental Prosecutions Unit; at time of signing. <br />20 10. Defendant is responsible for the uniform fee for filing the first paper in a civil action or <br />21 proceeding in the Superior Court. The amount of the filing fee is THREE HUNDRED NINETY - <br />22 FIVE DOLLARS ($395.00). Said payment shall be made 12Mble to the SAN JOAQUIN COUNTY <br />23 SUPERIOR COURT and delivered to the San Joaquin County Office of the District Attorney, <br />24 Environmental Prosecutions Unit, at time of signing. <br />25 11. At any time after the Final Judgment has been in effect for FIVE (5) years, and Defendant <br />26 has paid all amounts due hereunder, Defendantmay, with notice to Plaintiff, file a motion requesting <br />27 that the Court order that the Permanent injunction provisions of Paragraph 3 - 3k shall have no <br />28 prospective force or effect based on Defendants's demonstrated history of compliance with the Final <br />4 <br />PERMANENT INJUNCTION AND FINAL JUDGMENT PURSUANT TO STIPULATION <br />
