Mr. McCuaig asked Mr. Naidu if there was a way to resolve the violations and <br />make them "go away." Mr. Naidu stated that he could not make the violations "go awa <br />and that the facility needed to take appropriate action to resolve the issues because <br />each day they were not in compliance was a separate violation. Mr. Naidu explained <br />that the EHD's enforcement process is through the District Attorney's office and if and <br />when it is decided, a referral would be made to their office. I <br />On October 21, 2009, Mr. Naidu witnessed the secondary containment testing on the <br />UST system. All components were tested and passed, and a test report was submitted <br />sin site by the tester (Attachment 25). <br />On October 23, 2009, Mr. Fieock called Mr. Naidu regarding the violation for unpermitted <br />work in 2008 and stated that "UST is not our forteand that Fuel Oil Systems mislead <br />them "and let us down." Mr. Fieock also said that the EHD should consider Kaiser's <br />history in environmental compliance prior to making a decision to proceed with <br />enforcement. He also stated the Kaiser's Senior Vice President and Area Manager, Mr. <br />Corwin Harper was very concerned and wanted Mr. Naidu to let Mr. Fieock know prior to <br />sending the case for enforcement and he would arrange a meeting with the <br />11 governmental representative."
