L <br />0 <br />0 <br />u <br />n. <br />0 <br />n <br />n <br />G' <br />u <br />n <br />[J <br />Limited arrty <br />PWPipe warrants that its PVC pipe products were manufactured in <br />accordance with applicable materials and product specifications, and that the <br />pipe is free from all defects in materials and workmanship using the applicable <br />specifications as a standard. <br />Every claim under this warranty shall be deemed waived unless <br />presented in writing and received by PWPipe within sixty (60) days of the date <br />the defect was, or should have been discovered or within two (2) years of the <br />date of PWPipe's shipment of the product, whichever occurs sooner. <br />PWPipe makes no other warranty or representation of any kind, expressed <br />or implied, in fact or in law, including without limitation the warrant of <br />merchantability or fitness for a particular purpose, other than the limited warranty <br />set forth above. <br />Limitation of Li ili <br />It is expressly agreed that the limit of PWPipe's liability is the replacement <br />of defective product with the same quantity of non -defective product, and that <br />PWPipe shall have no such liability unless the claim results solely from breach of <br />PWPipe's warranty. <br />In no event shall PWPipe be liable for any incidental or consequential <br />damages of any kind, including without limitation, any expense or removal or <br />reinstallation resulting from any defect. <br />Some states do not allow the exclusion or limitation of incidental or <br />consequential damages, so the above limitation or exclusion may not apply to <br />you.
